Captain / Operator Listing Terms & Conditions

These Captain and Operator Listing Terms and Conditions (these 'Terms') govern your access to and use of the Reel Adventure Booking website, mobile interfaces, and related services (collectively, the 'Platform') for the purpose of listing vessels, creating Trip offerings, and accepting Bookings from Customers through the Platform. By creating a Captain or Operator account, listing a vessel, creating a Trip, or accepting a Booking, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not list Trips or accept Bookings through the Platform.
1. Platform Operator
The Platform is operated by Reel Adventure Booking (the 'Company,' 'Reel Adventure Booking,' 'we,' 'us,' or 'our'). These Terms form a legally binding agreement between you and the Company.
If you are creating an account or accepting these Terms on behalf of a business entity, you represent and warrant that you have authority to bind that entity to these Terms.
2. Definitions
For clarity, the following terms have the meanings set forth below. Additional defined terms may appear elsewhere in these Terms.
- 'Application Fee' means the platform fee retained by Reel Adventure Booking in connection with payments processed through Stripe Connect, as disclosed in your Captain dashboard or payout settings.
- 'Booking' means a reservation request or confirmed reservation for a Trip made through the Platform.
- 'Captain' or 'Operator' means the individual or business entity that lists a vessel, creates Trip offerings, and accepts Bookings through the Platform.
- 'Customer' means an individual who books a Trip through the Platform.
- 'Identity Verification' means the identity verification process conducted through Stripe Identity or other verification services designated by the Platform.
- 'Listing' means a Trip offering published by a Captain or Operator on the Platform.
- 'Remaining Balance' means any portion of a Trip price not collected through the Platform at checkout and due later online or in person, as disclosed to the Customer at booking.
- 'Stripe' means Stripe, Inc. and its affiliates, including Stripe payment processing, Stripe Connect, and Stripe Identity services.
- 'Stripe Connect Account' means the connected Stripe account established by a Captain or Operator to receive payouts for Trips booked through the Platform.
- 'Trip' means a fishing charter trip or other on-water experience offered by a Captain or Operator through the Platform.
- 'Vessel' means any boat or watercraft listed on the Platform for use in providing Trips.
3. Eligibility and Account Registration
You may create a Captain or Operator account and list Trips on the Platform only if you meet the eligibility requirements in these Terms and you are able to enter into a legally binding agreement. By registering as a Captain or Operator, creating a Listing, or accepting a Booking, you represent and warrant that you satisfy these requirements and that you will operate in compliance with these Terms and all applicable laws.
3.1 Minimum Age and Legal Capacity
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to register for a Captain or Operator account and to use the Platform as a trip provider. By registering, you represent that you have the legal capacity to enter into these Terms and to operate a charter business or provide Trips lawfully.
3.2 Business Entity and Authority to Bind
If you are registering or operating as a business entity, you represent and warrant that:
- Your business is validly formed and in good standing where applicable.
- You have full authority to bind the business entity to these Terms.
- All information submitted about the business, including legal name, tax status, and registration details, is accurate and current.
Reel Adventure Booking may require additional information to confirm your business identity, ownership, and control, including information required by Stripe Connect or other compliance and risk controls.
3.3 Account Creation and Required Information
To access Captain or Operator features, you must create an account through the Platform's listing flow and provide complete and accurate information, which may include:
- Your legal name and contact information.
- Business name, address, and registration information, if applicable.
- Captain licensing and credential information, including MMC and related documentation where required.
- Vessel registration details and vessel specifications.
- Proof of insurance and related coverage information.
- Stripe Connect account onboarding information.
- Any additional compliance information requested by the Platform or Stripe.
You agree to keep this information accurate and current at all times. You acknowledge that failure to maintain accurate information may result in listing suspension, payout delays, booking cancellations, or termination of your account.
3.4 Account Security and Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:
- Maintain secure passwords and account controls.
- Restrict account access to authorized users only.
- Notify Reel Adventure Booking promptly if you suspect unauthorized access, misuse, or a security incident.
You remain responsible for the actions of any person who accesses your account, whether authorized or not, unless and to the extent such access resulted from a failure of the Platform to implement reasonable security safeguards.
3.5 Accuracy, Non-Misrepresentation, and Ongoing Disclosure
You agree not to misrepresent:
- Your identity, credentials, or licensing status.
- Your vessel's registration, seaworthiness, capacity, or condition.
- Your insurance coverage, policy limits, or effective dates.
- Your ability to lawfully operate Trips in the jurisdictions where Trips depart.
- The nature, pricing, inclusions, or restrictions of any Trip you list.
You also agree to promptly disclose to Reel Adventure Booking any material change that affects your eligibility or ability to operate, including suspension or expiration of credentials, loss of insurance coverage, vessel unavailability, or regulatory enforcement actions.
3.6 Compliance With Platform Policies and Applicable Law
You agree to comply with:
- These Terms and all Platform policies applicable to Captains and Operators.
- All federal, state, and local laws and regulations applicable to your charter business, vessel operations, and Trips, including licensing and safety requirements.
- Coast Guard rules and any applicable maritime safety regulations.
- Anti-discrimination laws and consumer protection requirements.
Reel Adventure Booking may request evidence of compliance, including updated documentation, certifications, or confirmations, and may suspend Listings or account access pending verification.
3.7 Platform Review and Approval
The Platform may require administrative review or approval of Captain accounts, vessel documentation, insurance submissions, and Trip Listings. You acknowledge and agree that:
- Approval is not automatic.
- Platform review is a screening step and not a guarantee of legal compliance or safety.
- You remain solely responsible for lawful operation, safety, and compliance regardless of approval status.
The Platform may revoke approval or suspend your account if new information arises, documents expire, verification fails, or compliance concerns are identified.
4. Captain Identity Verification
To protect Customers, Captains, and the integrity of the Platform, Reel Adventure Booking requires identity verification for Captains and certain Operators. Identity Verification is conducted through Stripe Identity and may include validation of personal information, identity documents, and related verification checks.
You may not list Trips, accept Bookings, or receive payouts through the Platform unless you have successfully completed Identity Verification and remain in good standing.
4.1 Identity Verification Requirement
You agree to complete Identity Verification promptly upon request and prior to activating Listings or receiving payouts. Verification requirements may apply to:
- Individual Captains.
- Owners, controllers, or representatives of an Operator business entity where required by Stripe or compliance rules.
- Additional personnel associated with your account where required for risk or compliance purposes.
Identity Verification requirements may change over time based on Stripe requirements, legal obligations, fraud prevention measures, or Platform policies.
4.2 Information and Documentation Provided for Verification
You agree to provide accurate, current, and complete information requested for Identity Verification, which may include:
- Legal name, date of birth, and address.
- Government-issued identification documents.
- Selfie or liveness checks.
- Business ownership and control information where applicable.
You represent and warrant that all information and documents you submit are genuine, valid, and belong to you or, if submitted for a business entity, are submitted with proper authorization.
4.3 Verification Status and Platform Access
Your ability to use Captain features may depend on verification status. The Platform may:
- Limit your account functionality until verification is completed.
- Prevent activation of Listings or acceptance of Bookings until verification is approved.
- Place holds on payouts until verification is completed or re-verified.
You acknowledge that verification decisions and processing timing may be affected by Stripe's systems and policies and by the responsiveness and accuracy of your submissions.
4.4 Failure, Delay, or Revocation of Verification
If Identity Verification fails, is incomplete, is delayed, or is later revoked, Reel Adventure Booking may, in its reasonable discretion:
- Suspend or deactivate your Listings.
- Prevent acceptance of new Bookings.
- Cancel upcoming Trips where necessary to protect Customers or comply with legal requirements.
- Delay or withhold payouts to the extent permitted by Stripe policies and applicable law.
- Require additional documentation or re-verification.
You acknowledge that Stripe and other compliance providers may require re-verification periodically or upon certain triggers, including account changes, unusual activity, disputes, or regulatory requirements.
4.5 Cooperation and Ongoing Compliance
You agree to cooperate with reasonable requests related to identity verification, fraud prevention, and legal compliance, including providing additional information or documentation. You also agree to notify Reel Adventure Booking promptly if:
- You change your legal name.
- Your government identification changes or expires.
- Your business ownership, control, or authorized representatives change.
- You become aware of suspected identity theft or unauthorized use of your account.
4.6 No Platform Liability for Verification Outcomes
Reel Adventure Booking does not guarantee that Identity Verification will be completed within a specific time or that verification will be approved. Reel Adventure Booking is not liable for losses arising from verification delays, failures, or Stripe compliance decisions, including missed booking opportunities or payout delays, except to the extent caused by the Platform's own failure to process information it receives in a reasonable manner.
5. Licensing and Credential Requirements
You are solely responsible for ensuring that you, your crew, your business, and your Trips comply with all licensing, credentialing, and regulatory requirements applicable to fishing charters and vessel operations. Reel Adventure Booking may require submission of licensing and credential documentation for administrative review as a condition of listing or continuing to offer Trips on the Platform, but any review by the Platform does not replace your independent compliance obligations.
5.1 Captain Licensing and MMC Requirements
If you operate or captain Trips offered through the Platform, you must maintain all licenses and credentials required to lawfully operate as a charter captain for the Trips you offer. This includes, as applicable:
- A valid United States Coast Guard captain license or Merchant Mariner Credential, including any required endorsements.
- Any state or local charter captain credentials required for the Trip departure location.
- Any required permits or registrations tied to your charter operations.
You agree that you will not list or conduct any Trip for which you do not hold the required license or credential.
5.2 Submission of Credentials for Administrative Review
The Platform may require you to submit copies of your captain license, Merchant Mariner Credential, endorsements, and related documentation for administrative review before you can activate Listings or accept Bookings. You agree to submit accurate and legible documentation and to provide updates whenever your credentials are renewed, reissued, modified, suspended, or replaced.
You acknowledge and agree that:
- Platform review is a screening step only.
- Approval by the Platform is not a guarantee that your credentials are valid, sufficient, or compliant.
- You remain fully responsible for ensuring legal compliance at all times.
5.3 Ongoing Validity and Renewal Obligations
You agree to maintain your credentials in active, valid status without lapse. You are responsible for monitoring expiration dates and renewal timelines and for promptly submitting updated documents to the Platform.
If your credentials expire, are suspended, are revoked, or otherwise become invalid, you must immediately stop offering and conducting Trips through the Platform and promptly notify Reel Adventure Booking.
5.4 Operator and Business Registration Requirements
If you operate through a business entity, you are responsible for maintaining business registration, licensing, and good standing requirements applicable to your charter operations, including any required:
- Business registrations or permits.
- Charter operator licenses where required.
- Tax registrations and compliance obligations.
- Local marina or port authorizations where applicable.
Reel Adventure Booking may request supporting documentation for business registration or authority to operate. Failure to provide accurate business information may result in suspension of Listings, payout delays, or termination.
5.5 Compliance With Safety and Operating Regulations
You agree to operate your vessel and Trips in compliance with all applicable maritime and safety regulations, including Coast Guard rules and any applicable passenger capacity, equipment, and operational requirements.
You represent and warrant that you will not misrepresent passenger capacity, licensing scope, or operating authority in any Trip listing or in any communication with Customers.
5.6 Consequences of Non-Compliance
If Reel Adventure Booking determines, in its reasonable discretion, that your licensing or credential documentation is missing, expired, invalid, inconsistent, or otherwise non-compliant, the Platform may:
- Suspend or deactivate your Listings.
- Prevent acceptance of new Bookings.
- Cancel upcoming Trips where necessary to protect Customers or ensure compliance.
- Delay or withhold payouts to the extent permitted by Stripe policies and applicable law.
- Require re-verification, additional documentation, or confirmations.
You acknowledge that failure to maintain proper credentials may expose Customers and the Platform to safety risks and legal liability, and you agree that the Platform may take immediate enforcement action where necessary.
6. Vessel Registration and Insurance Requirements
You are solely responsible for ensuring that every Vessel used for Trips listed on the Platform is lawfully registered, properly maintained, seaworthy, and insured as required by applicable law and prudent charter operations. Reel Adventure Booking may require documentation submission and administrative review as a condition of listing or continuing to offer Trips, but any review by the Platform does not replace your obligations or create any warranty or assurance regarding compliance, safety, or coverage.
6.1 Vessel Registration and Ownership Documentation
For each Vessel you list or assign to a Trip, you agree to maintain valid and current registration and to provide documentation upon request, which may include:
- Vessel registration certificate or documentation issued by the applicable authority.
- Hull identification information, registration number, and other identifying details.
- Proof of ownership or lawful authority to operate the Vessel for charter purposes where applicable.
- Any required permits or authorizations tied to the Vessel, marina, or departure location.
You represent and warrant that all information you provide regarding a Vessel, including capacity, condition, and identifying details, is accurate and not misleading.
6.2 Seaworthiness, Maintenance, and Operational Readiness
You agree that you will use only Vessels that are safe, mechanically sound, and suitable for the Trips you offer. You are solely responsible for:
- Routine maintenance and inspection.
- Ensuring required safety equipment is present and functional.
- Compliance with passenger capacity limits and operational restrictions.
- Ensuring the Vessel is fit for the weather, sea state, and Trip type.
You will not list or operate any Trip using a Vessel that is unsafe, uninspected where inspection is required, out of service, mechanically compromised, or otherwise unfit for passenger use.
6.3 Insurance Requirements and Proof of Coverage
You agree to maintain valid insurance coverage appropriate for charter operations and passenger carriage. Coverage expectations may vary by Trip type, location, vessel class, and legal requirements. The Platform may require you to provide proof of insurance, which may include:
- Certificate of insurance or declarations page showing policy number, effective dates, and coverage limits.
- Evidence of marine liability coverage or other applicable charter liability coverage.
- Commercial general liability coverage where applicable.
- Any additional insured endorsements or coverage confirmations required by specific marinas or operations.
You represent and warrant that your insurance is valid, active, and sufficient for your charter operations and that you will not accept Bookings or operate Trips during any lapse in coverage.
6.4 Ongoing Update Obligations
You agree to keep vessel registration and insurance information current and to update the Platform promptly if any of the following occur:
- Insurance coverage is canceled, non-renewed, reduced, or materially modified.
- A policy expires or is replaced.
- The Vessel registration expires, is modified, or is reissued.
- The Vessel is sold, transferred, substituted, or becomes unavailable.
- The Vessel suffers damage, is involved in a casualty, or becomes unseaworthy.
You acknowledge that expired documents or incomplete submissions may cause Listing suspension or booking restrictions until updated documentation is provided.
6.5 Administrative Review Does Not Create Verification or Liability
Reel Adventure Booking may review vessel registration and insurance documents for administrative completeness and marketplace screening purposes. You acknowledge and agree that:
- The Platform does not verify the authenticity, enforceability, or adequacy of your documents.
- The Platform does not evaluate policy exclusions, carrier financial strength, or claims handling.
- Approval or acceptance of documents does not create a warranty that a Vessel is safe, compliant, or insured.
- You remain solely responsible for compliance, safety, and coverage.
6.6 Consequences of Missing, Expired, or Invalid Documentation
If Reel Adventure Booking determines, in its reasonable discretion, that vessel registration or insurance documentation is missing, expired, inconsistent, misleading, or otherwise non-compliant, the Platform may take actions including:
- Suspending or deactivating one or more Vessels from the Platform.
- Suspending or deactivating Listings tied to that Vessel.
- Preventing acceptance of new Bookings.
- Canceling upcoming Trips where necessary to protect Customers or ensure compliance.
- Delaying or withholding payouts where permitted by Stripe policies and applicable law.
- Requiring additional documentation, confirmations, or re-verification.
You agree that the Platform may take immediate action where necessary to prevent safety risks, fraud, or legal exposure.
6.7 Customer Claims and Cooperation
If a Customer raises a safety concern, incident report, or claim involving a Vessel, you agree to cooperate reasonably with Platform requests for information, including providing insurance carrier information and incident details as necessary for dispute resolution and compliance purposes. This cooperation obligation does not create any admission of liability and does not expand the Platform's responsibility for Trip operations.
7. Trip Listing and Content Standards
You are responsible for all information you submit to the Platform, including Trip Listings, pricing, availability, photos, policies, and communications with Customers. Listings must be accurate, complete, and not misleading. You agree that all Trips offered through the Platform will be operated in a professional manner consistent with applicable law, safety requirements, and these Terms.
7.1 Listing Creation and Publication
The Platform provides tools that allow you to create Listings for Trips. A Listing may include Trip descriptions, departure location, duration, passenger capacity, target species, included items, restrictions, cancellation terms, pricing, and scheduling.
Reel Adventure Booking may require administrative review or approval of Listings before they are published or before you may accept Bookings. You acknowledge that approval is not guaranteed and that the Platform may reject or require modifications to a Listing for compliance, safety, marketplace quality, or operational reasons.
7.2 Accuracy, Completeness, and No Misleading Information
You represent and warrant that all Listing information is true, accurate, current, and complete, including:
- Vessel details and passenger capacity.
- Captain identity, credentials, and operating authority.
- Departure location, launch site, and meeting instructions.
- Trip duration, start time, and expected return window.
- What is included, what is not included, and what Customers must bring.
- Any limitations related to age, physical requirements, or passenger readiness.
- Any additional fees, surcharges, or charges not included in the displayed price.
- Your cancellation and rescheduling terms as permitted by the Platform.
You agree not to omit material information that would reasonably affect a Customer's decision to book.
7.3 Trip Requirements and Disclosures
You must clearly disclose any Trip-specific requirements and restrictions, including:
- Minimum and maximum passenger counts.
- Required fishing licenses or permits and who is responsible for obtaining them.
- Rules regarding alcohol, smoking, prohibited items, or conduct.
- Accessibility limitations, boarding requirements, or physical participation expectations.
- Weather limitations and how you handle weather-related cancellations or rescheduling.
- Any waivers or acknowledgments you require Customers to sign before departure.
You agree that you will not impose new material requirements after a Booking is confirmed unless necessary for safety or legal compliance and communicated promptly to the Customer.
7.4 Pricing Authority and Pricing Integrity
You control the Trip price displayed in your Listing, subject to Platform rules and fee structures. You agree that pricing must be transparent and must not be deceptive. You will not:
- Misrepresent the total price or hide mandatory charges.
- Advertise a price that you do not intend to honor.
- Increase the price after a Booking is confirmed except through a mutually agreed modification processed through the Platform where such functionality is supported.
If you offer optional add-ons or upgrades, you must disclose the price and terms clearly. Charges collected outside the Platform must be disclosed as such, and you remain responsible for compliance with applicable consumer protection laws.
7.5 Availability, Scheduling, and Calendar Accuracy
You are responsible for maintaining accurate availability and scheduling information. You agree to:
- Keep your Trip calendar up to date.
- Avoid double-booking and prevent conflicts with other commitments.
- Promptly disable availability for dates you cannot operate.
- Respond to booking requests within any response time requirements stated by the Platform.
Failure to maintain accurate availability may result in canceled Bookings, negative reviews, account restrictions, or reduced listing visibility.
7.6 Shared-Seat and Capacity-Based Listings
If you offer shared-seat or per-person Trips, you must accurately disclose:
- Maximum capacity and how seats are allocated.
- Whether a Trip requires a minimum number of participants to proceed.
- How you handle sell-outs, waitlists, and partial capacity situations.
- How you handle changes in participant count, including no-shows.
You agree to honor confirmed Bookings subject only to legitimate safety and operational constraints and to avoid cancellations that result from poor capacity management.
7.7 Listing Media and Content Rights
If you upload photos, videos, logos, or other content, you represent that you own the content or have the legal right to use it. You agree not to upload content that:
- Infringes intellectual property rights.
- Contains misleading images not representative of your Trips or Vessel.
- Contains illegal, obscene, or unsafe content.
- Violates privacy rights, including by posting identifiable images of individuals without appropriate permission.
By uploading content, you grant Reel Adventure Booking a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content in connection with the Platform, marketing, and promotional activities, subject to applicable law and the Platform's policies.
7.8 Prohibited Listings and Prohibited Conduct
You may not list Trips or offer services that:
- Are unlawful or violate licensing requirements.
- Involve unsafe practices or unreasonable risk.
- Discriminate unlawfully against Customers.
- Include prohibited activities not allowed by the Platform.
- Encourage Customers to book or pay outside the Platform.
You may not use the Platform to solicit Customers for off-platform bookings or to avoid Platform fees.
7.9 Platform Enforcement and Listing Removal
Reel Adventure Booking may suspend, restrict, modify, or remove Listings at any time if the Platform reasonably determines that a Listing:
- Is inaccurate, misleading, or incomplete.
- Presents safety or compliance concerns.
- Violates these Terms or Platform policies.
- Generates repeated disputes, complaints, or chargebacks.
- Appears to involve circumvention or improper conduct.
The Platform may require you to update your Listing as a condition of continued publication. Repeated violations may result in account suspension or termination.
8. Booking Acceptance and Trip Operations
When you list Trips on the Platform, you are offering availability to Customers subject to the Listing details and any acceptance model supported by the Platform. You agree to operate professionally, communicate promptly, and provide Trips as described in your Listings, subject only to legitimate safety, weather, and compliance considerations.
8.1 Booking Models and Confirmation
The Platform may support different booking models depending on Trip type, market, or feature settings, including:
- Instant confirmation where a Booking is confirmed upon successful payment.
- Request and acceptance where you must affirmatively accept a Booking request before it is confirmed.
- Conditional confirmation where confirmation depends on final checks such as capacity, scheduling, or other operational factors disclosed to the Customer.
You agree to honor confirmed Bookings in accordance with your Listing, the applicable cancellation policy, and these Terms.
8.2 Response Time and Communication Obligations
You agree to respond to Customer inquiries and Booking requests promptly and professionally. If the Platform imposes response time expectations, you agree to meet them.
You are responsible for communicating Trip logistics clearly, including meeting location, arrival time, boarding instructions, what to bring, and any licensing or documentation requirements. You must provide reasonable notice to Customers of any material changes to Trip details.
Failure to respond or repeated delays in responding may result in lower listing visibility, booking restrictions, or account enforcement actions.
8.3 Trip Performance and Service Standards
You agree to provide Trips in a professional manner consistent with industry standards and in material accordance with your Listing description. This includes:
- Operating the Trip at the scheduled time and location, subject to weather and safety conditions.
- Providing the vessel, equipment, and inclusions described in your Listing or making reasonable substitutes if necessary.
- Maintaining appropriate customer service standards during communications and Trip performance.
- Avoiding deceptive or misleading representations regarding fishing results, trip guarantees, or vessel capabilities.
Fishing outcomes vary and are not guaranteed. However, you may not misrepresent expected outcomes or use misleading marketing practices.
8.4 Safety and Legal Compliance During Trips
You are solely responsible for Trip safety. You agree to:
- Operate the Vessel safely and lawfully at all times.
- Comply with Coast Guard requirements and applicable maritime safety regulations.
- Maintain and use required safety equipment, including life jackets and emergency gear.
- Provide safety briefings and enforce onboard safety rules appropriate to the Trip type.
- Refuse to operate in unsafe weather or sea conditions.
You acknowledge that Customers rely on you to make professional safety decisions. Safety decisions may require delays, route changes, early termination, or cancellation.
8.5 Passenger Management and Minimum Requirements
You are responsible for managing passengers during the Trip and ensuring compliance with Trip rules. You agree to clearly disclose any minimum requirements for participation, including:
- Minimum age rules.
- Maximum capacity.
- Physical requirements for boarding and participation.
- Rules regarding alcohol, smoking, or prohibited items.
You may refuse participation or terminate a Trip only when reasonably necessary for safety, compliance, or serious misconduct, and you must handle such situations consistently with applicable law and the cancellation terms disclosed at booking.
8.6 Refusal of Service, Removal, and Trip Termination
You may deny boarding, remove passengers, or terminate a Trip early where reasonably necessary for safety or compliance, including if a Customer or passenger:
- Is intoxicated or impaired and creates a safety risk.
- Possesses illegal drugs or unlawful weapons.
- Engages in harassment, threats, violence, or unsafe behavior.
- Refuses to follow safety instructions.
- Lacks required documentation or fishing licenses where required.
- Exceeds disclosed passenger limits or violates material Trip rules.
If you refuse service or end a Trip for the reasons above, you must document the circumstances in a professional manner and cooperate with Platform requests for information if a dispute arises.
Refund outcomes in these situations will be governed by the Trip-specific cancellation terms and applicable law. You may not use refusal of service as a pretext to cancel Bookings for convenience or to rebook at a higher price.
8.7 No Substitution Without Disclosure
You may not substitute a different vessel, different Captain, or materially different Trip experience from what was booked unless:
- The substitution is disclosed to the Customer in advance, and
- The Customer consents where the change is material, and
- The substitution remains lawful and safe and meets the Listing requirements.
Emergency substitutions may occur due to mechanical issues or safety concerns, but you must communicate promptly and offer rescheduling or cancellation options consistent with Platform policies and the applicable cancellation terms.
8.8 Incident Reporting and Cooperation
If an incident occurs during a Trip, including injury, property damage, law enforcement interaction, or significant safety event, you agree to:
- Prioritize safety and emergency response.
- Comply with applicable reporting obligations.
- Notify Reel Adventure Booking promptly through designated channels if the incident is likely to result in a claim, dispute, or safety investigation.
- Cooperate reasonably with Platform requests for information necessary for safety review, customer support, or legal compliance.
This cooperation obligation does not create any admission of liability and does not expand the Platform's responsibility for Trip operations.
9. Payment Processing and Stripe Connect
The Platform supports online payments through Stripe and uses Stripe Connect to facilitate payouts to Captains and Operators. To list Trips, accept eligible online payments, and receive payouts through the Platform, you must successfully complete Stripe Connect onboarding and maintain an active Stripe Connect Account in good standing.
You acknowledge that Stripe is a third-party payment processor and that your use of Stripe services is subject to Stripe's terms, policies, and compliance requirements. Reel Adventure Booking does not control Stripe's independent decisions regarding onboarding, verification, payout timing, reserves, risk controls, or account restrictions.
9.1 Stripe Connect Account Requirement
You agree to establish and maintain a Stripe Connect Account in the format designated by the Platform, which may include Stripe Express. You must provide all information required by Stripe and by the Platform to complete onboarding, including identity, business, and banking information.
If Stripe Connect onboarding is incomplete, rejected, or later restricted, the Platform may limit your ability to:
- Receive payouts through the Platform.
- Accept certain Bookings that require online payment.
- Create new Listings or accept new Bookings.
You remain responsible for all Trip obligations even if your payout access is delayed or restricted.
9.2 Merchant of Record and Payment Roles
For online payments processed through the Platform, Stripe may route funds to your Stripe Connect Account in accordance with Stripe Connect settings and Platform payout configuration. Depending on the specific transaction flow, the Platform may collect funds and facilitate payout or Stripe may route funds directly to your connected account while the Platform retains an Application Fee.
You acknowledge and agree that:
- Stripe controls the mechanics of payment processing, routing, and settlement.
- Stripe may require additional verification or impose limitations based on risk and compliance.
- Card issuers may reverse, decline, or dispute charges, and such outcomes may affect your payouts.
9.3 Application Fees and Platform Fee Retention
Where applicable, Reel Adventure Booking may retain an Application Fee on transactions processed through Stripe Connect. Application Fees may be configured through Stripe as application fees and may vary by Trip type, booking channel, market, promotions, or other factors disclosed to you in your Captain dashboard or payout settings.
You authorize Stripe and Reel Adventure Booking to deduct the applicable Application Fee from transaction amounts processed through the Platform where disclosed and supported by the Platform configuration.
9.4 Payout Timing, Delays, and Stripe Controls
Payout timing depends on Stripe's payout schedules, verification status, transaction risk assessments, dispute activity, chargeback exposure, and other factors. Reel Adventure Booking does not guarantee payout timing and is not responsible for delays caused by Stripe, banking networks, or compliance requirements.
Stripe may delay, hold, or restrict payouts for reasons including:
- Incomplete identity or business verification.
- Changes in account information.
- Dispute or chargeback activity.
- Risk controls, reserves, or compliance holds.
- Regulatory or legal requirements.
You acknowledge that payout timing may be affected even after you have successfully conducted Trips.
9.5 Reserves, Holds, and Negative Balances
Stripe or the Platform may impose reserves, rolling holds, or payout delays in response to risk factors, dispute levels, fraud indicators, or compliance requirements. Stripe may also create a negative balance on your connected account if refunds, chargebacks, or disputes exceed available funds.
You agree that you are responsible for resolving negative balances and for funding your Stripe Connect Account where required by Stripe's policies. Reel Adventure Booking may take reasonable actions to mitigate risk, including limiting Bookings, restricting payout functionality, or adjusting payment settings where permitted.
9.6 Refunds, Chargebacks, and Disputes Impacting Payouts
Refunds, chargebacks, and disputes may reduce payout amounts or create delays. You agree to cooperate with Stripe and Platform requests related to disputes, including providing supporting documentation for Trip delivery, cancellation outcomes, and customer communications.
If a chargeback or dispute is initiated, Stripe may withdraw funds from your Stripe Connect Account or withhold payouts pending resolution. Reel Adventure Booking is not liable for losses arising from chargebacks, dispute outcomes, or Stripe's enforcement decisions.
9.7 Failure to Maintain Stripe Connect Account
If your Stripe Connect Account is suspended, closed, restricted, or otherwise not in good standing, the Platform may:
- Suspend your Listings.
- Prevent acceptance of new Bookings.
- Cancel upcoming Trips where necessary to protect Customers.
- Restrict payout functionality.
- Require re-onboarding, additional verification, or updated banking information.
You acknowledge that you are solely responsible for maintaining accurate banking information and Stripe compliance status.
9.8 No Platform Liability for Payment Processing Services
Reel Adventure Booking is not responsible for third-party payment processing failures, including Stripe service outages, issuer declines, delayed settlement, fraud controls, banking delays, or verification requirements. The Platform's role is to integrate Stripe services and facilitate payment flow as configured.
Nothing in these Terms creates any obligation for Reel Adventure Booking to advance funds, guarantee payouts, or compensate you for Stripe payment processing decisions.
10. Deposits, Remaining Balances, and In-Person Payments
The Platform may support different payment structures depending on the Trip, timing, and eligibility settings, including Deposit payments, Full Payment at checkout, and Remaining Balance payments due later. You agree to comply with the payment structure disclosed to the Customer at booking and you agree not to impose additional payment requirements that contradict the checkout disclosures.
10.1 Payment Structure Disclosed at Checkout Controls
For each Booking, the Platform will disclose the applicable payment structure to the Customer during checkout, including whether the Customer must pay:
- A Deposit to confirm the Booking.
- Full Payment to confirm the Booking.
- A Remaining Balance due later, either online through the Platform when available or in person directly to you.
You agree that the checkout disclosures and Booking confirmation reflect the binding payment structure for that Booking. You will not alter the payment structure after confirmation except through a mutually agreed modification processed through the Platform where such functionality exists.
10.2 Deposit Payments
If a Booking uses a Deposit model, the Deposit amount collected at checkout is intended to confirm or hold the reservation. Unless otherwise disclosed during checkout:
- Deposit payments may be a percentage of the Trip price, commonly twenty percent (20%).
- Deposit timing and refundability are governed by the cancellation and refund policy disclosed at checkout.
- A Deposit does not eliminate the Customer's obligation to pay any Remaining Balance when due.
You agree not to require additional deposits or extra upfront payments outside the Platform for a Booking that has already been confirmed through the Platform deposit flow.
10.3 Remaining Balance Payment Methods
If a Booking includes a Remaining Balance, the Platform may permit the Customer to pay the Remaining Balance:
- Online through the Platform on a later date when available, including through optional scheduled payment features, or
- In person directly to you if the Trip is not eligible for online Remaining Balance collection.
The Platform will communicate the applicable method to the Customer at booking. You agree to honor the disclosed method and not to require an alternative payment method as a condition of providing the Trip.
10.4 In-Person Collection of Remaining Balances
If a Remaining Balance is designated as payable in person:
- You are solely responsible for collecting the Remaining Balance directly from the Customer.
- You are responsible for complying with all laws applicable to in-person payments, including receipt requirements and consumer protection rules.
- Reel Adventure Booking is not the merchant of record for the in-person payment and does not process, hold, or refund in-person amounts unless expressly stated otherwise.
You agree to clearly communicate acceptable in-person payment methods, if any, consistent with your Listing disclosures and customer communications. You also agree not to impose surprise charges, mandatory gratuities not disclosed in advance, or undisclosed add-on fees at the dock.
10.5 Prohibition on Off-Platform Deposits and Improper Payment Requests
You agree not to request or accept payment outside the Platform for any portion of a Booking that is designated to be paid through the Platform, including Deposits or any online Remaining Balance payments.
You may not:
- Ask Customers to pay by cash, wire, peer-to-peer payment, or other off-platform method in order to avoid Platform fees.
- Require Customers to cancel a Platform Booking and rebook directly with you.
- Solicit future trips off the Platform using Platform communications.
Violations of this section may result in immediate enforcement actions, including listing suspension, booking cancellation, loss of payout access, or account termination.
10.6 Customer Non-Payment of Remaining Balance
If a Customer fails to pay a Remaining Balance when due, you may treat the situation as a customer cancellation or no-show, but only in accordance with:
- The cancellation and refund policy disclosed at checkout, and
- Applicable law.
You agree to notify the Platform promptly if a Customer refuses to pay an in-person Remaining Balance or if payment failure prevents Trip performance. You also agree to provide documentation reasonably requested by the Platform to address disputes.
10.7 Refund Responsibilities for In-Person Amounts
Refunds for amounts paid in person directly to you are your responsibility. Reel Adventure Booking does not issue refunds for in-person amounts and does not guarantee that a Customer will be reimbursed for in-person payments.
If a Customer dispute arises relating to in-person payments, you agree to handle the matter professionally, provide receipts or documentation where available, and cooperate with reasonable Platform requests necessary for dispute resolution.
10.8 No Additional Fees Without Disclosure
You may charge only those amounts that are disclosed to the Customer in advance through your Listing and the Platform checkout flow, except where an additional charge is optional, clearly disclosed, and accepted by the Customer.
Any mandatory charges not disclosed at booking may be treated as a violation of Platform policy and may result in enforcement actions.
11. Cancellations, Rescheduling, and Refund Responsibilities
Cancellations and refund outcomes depend on the specific cancellation terms disclosed in your Listing and presented to the Customer at checkout. You agree to apply the disclosed policy consistently, communicate promptly, and cooperate with Platform processes for refunds, credits, and dispute resolution.
11.1 Trip-Specific Cancellation Terms Control
For each Trip you list, you must disclose cancellation and rescheduling terms as permitted by the Platform. The cancellation terms presented to the Customer at checkout for a specific Booking control that Booking.
You may not apply different cancellation terms after a Booking is confirmed unless the Customer affirmatively agrees to the change through a Platform-supported modification process.
11.2 Captain and Operator Cancellations
You may cancel a Trip only for legitimate operational reasons, including safety concerns, severe weather, mechanical failure, compliance issues, or other circumstances that make it unreasonable or unsafe to perform the Trip.
If you cancel a confirmed Booking, you agree to:
- Provide notice to the Customer as soon as reasonably practicable.
- Provide a clear reason for cancellation where appropriate.
- Cooperate with Platform processes to issue refunds or credits for amounts paid through the Platform, consistent with checkout disclosures and applicable law.
- Avoid repeated or avoidable cancellations that harm Customers or marketplace integrity.
The Platform may track cancellation rates, cancellation patterns, and customer complaints, and may reduce listing visibility, restrict booking access, or suspend accounts where cancellations indicate reliability issues.
11.3 Weather and Safety Cancellations
Fishing charters are weather-dependent and safety-sensitive. You are responsible for making professional safety decisions. If weather or marine conditions require cancellation, delay, shortening, or rescheduling of a Trip, you agree to:
- Communicate promptly with the Customer through the Platform regarding the status of the Trip.
- Follow the weather-related cancellation and rescheduling approach disclosed in your Listing and at checkout.
- Offer rescheduling options where practical and where consistent with your policy.
- Document the basis for the decision if a dispute is likely, including marine advisories or safety conditions.
If a Trip starts but is shortened due to weather or safety conditions, any refund or partial refund outcome will be determined by the Trip-specific policy disclosed at checkout and applicable law. You may not use weather as a pretext to cancel for convenience or for commercial advantage.
11.4 Customer Cancellations and Rescheduling Requests
If a Customer cancels, refund outcomes are governed by the cancellation policy disclosed at checkout. You agree not to impose additional cancellation fees or penalties beyond what was disclosed.
If the Customer requests rescheduling, you may offer rescheduling in accordance with your disclosed policy, including any limits on reschedules or time windows, but you are not required to reschedule unless your policy provides for it or you otherwise choose to do so.
You agree to handle rescheduling decisions in a commercially reasonable manner and to communicate clearly to Customers about available options.
11.5 No-Shows and Late Arrivals
Customers are responsible for arriving on time and complying with meeting instructions. If a Customer fails to appear, arrives too late to reasonably conduct the Trip, lacks required documentation, or is refused service for safety reasons, you may treat the situation as a no-show or customer cancellation in accordance with the cancellation terms disclosed at checkout.
You agree to document no-shows and serious late arrivals in the Platform records where possible and to cooperate with the Platform if a dispute arises.
11.6 Refunds for Amounts Paid Through the Platform
Refunds of amounts paid through the Platform are processed through Stripe in the manner supported by the Platform. You agree to cooperate with Platform refund workflows, which may include:
- Confirming cancellation circumstances.
- Confirming whether services were provided.
- Providing supporting documentation for disputes.
- Responding to Platform inquiries in a timely manner.
You acknowledge that refund processing times depend on Stripe and the Customer's financial institution. Reel Adventure Booking does not control bank posting times once a refund is initiated.
11.7 In-Person Payments and Refund Responsibility
If a Customer paid any portion of the Trip price to you in person, you are solely responsible for handling any refunds of those in-person amounts, unless the Platform expressly states otherwise for a specific Trip or transaction flow.
You agree not to direct Customers to Reel Adventure Booking for refunds of in-person payments that the Platform did not collect.
11.8 Disputes, Chargebacks, and Cooperation Duties
If a Customer initiates a payment dispute or chargeback, you agree to cooperate with requests for evidence and documentation, which may include:
- Booking confirmation and Trip details.
- Communication records.
- Proof of service delivery.
- Weather advisories or safety-related cancellation rationale.
- Photographs, logs, or other relevant operational records.
You acknowledge that Stripe or payment method issuers may make independent decisions regarding chargebacks and disputes, and that dispute outcomes may affect your payouts, reserve status, or account standing.
11.9 Platform Enforcement for Cancellation Abuse
Reel Adventure Booking may take enforcement actions if it reasonably determines that you:
- Cancel Bookings excessively or without legitimate reasons.
- Fail to communicate cancellations promptly.
- Misapply cancellation terms.
- Encourage Customers to cancel and rebook off-platform.
- Engage in conduct that increases disputes or harms Customers.
Enforcement actions may include listing suppression, booking restrictions, payout holds where permitted, or termination.
12. Platform Fees and Non-Circumvention
Reel Adventure Booking provides marketplace, booking, payment, and operational tools that support your ability to market Trips, accept Bookings, and receive payouts. In exchange, the Platform may charge fees and enforces strict rules designed to protect marketplace integrity, prevent fraud, and ensure fair operation for all users.
12.1 Platform Fees and Application Fees
The Platform may charge fees in connection with your use of the Platform, including Application Fees retained on transactions processed through Stripe Connect. Platform fee structures may include:
- A percentage-based fee retained from the Trip price.
- A fixed fee per Booking.
- A blended model based on Trip type, market, or promotional settings.
The applicable fee structure for your account will be disclosed through your dashboard, payout settings, Listing tools, or other Platform disclosures. You authorize Reel Adventure Booking and Stripe to deduct the applicable Platform fees and Application Fees from transactions processed through the Platform as configured.
12.2 Fee Changes
Reel Adventure Booking may modify Platform fee structures from time to time. If changes apply to future Bookings, we may provide notice through the Platform, your dashboard, email communications, or Listing tools.
Fee changes generally apply only prospectively to future Bookings. Confirmed Bookings remain subject to the fee structure in effect at the time of confirmation unless a change is required by law or is otherwise disclosed and accepted through a Platform-supported modification flow.
12.3 Taxes on Fees
You are responsible for determining and paying any taxes applicable to your business revenue, including taxes related to Trip income and Platform fee deductions. Reel Adventure Booking does not provide tax advice. Stripe may provide reporting tools, and you are responsible for reviewing those tools and consulting your advisors as needed.
12.4 Strict Non-Circumvention Rules
You agree not to circumvent the Platform. Circumvention includes any attempt to avoid Platform fees, remove transactions from the Platform, or redirect Customers away from the Platform to book or pay you directly.
You may not, directly or indirectly:
- Encourage or request that a Customer book outside the Platform.
- Provide contact details or payment instructions for off-platform payment for a Platform Booking.
- Ask a Customer to cancel a Platform Booking and rebook directly with you.
- Offer discounts, special packages, or benefits conditioned on booking or paying off-platform.
- Use Platform communications to solicit future trips outside the Platform.
- Use any method to identify Customers obtained through the Platform and convert them into off-platform clients.
These restrictions apply during and after any Booking and apply whether the conduct occurs through Platform messaging, email, phone, text, social media, or in person.
12.5 Permitted Off-Platform Activity
Nothing in these Terms prohibits you from operating your independent business outside the Platform. However, Customers you acquire through the Platform may not be diverted off-platform for transactions that are reasonably connected to Platform Bookings or that are designed to avoid Platform fees.
If a Customer independently finds you outside the Platform and books you directly without any connection to Platform activity, that transaction is not governed by this section. However, you may not use Platform information or communications to cause that outcome.
12.6 Enforcement and Remedies
Circumvention undermines marketplace trust and causes financial harm to the Platform. If Reel Adventure Booking reasonably determines that you attempted to circumvent the Platform, the Platform may take enforcement actions including:
- Removing or suppressing Listings.
- Canceling pending Bookings.
- Suspending your account or restricting Captain features.
- Limiting payout functionality to the extent permitted by Stripe policies and applicable law.
- Terminating your account.
- Seeking reimbursement for unpaid fees and losses caused by circumvention, to the extent permitted by law.
You acknowledge that circumvention may also expose you to disputes, chargebacks, and reputational harm, and may reduce Customer trust and marketplace access.
12.7 No Waiver by Failure to Enforce
Reel Adventure Booking's failure to enforce this section in any specific instance does not waive the Platform's right to enforce it later. The Platform may take enforcement action based on patterns of behavior, audit information, customer complaints, or internal monitoring.
13. Communications and Professional Conduct
The Platform may provide messaging, chat, email relay, or other communication tools that allow you to communicate with Customers regarding Listings, Bookings, Trip logistics, and operational requirements. You agree to use these tools professionally and only for legitimate business purposes connected to Platform activity.
13.1 Professional Communications Standard
You agree to communicate with Customers in a timely, respectful, and professional manner. This includes:
- Responding to booking-related inquiries and messages promptly.
- Providing clear and accurate Trip logistics, meeting instructions, and requirements.
- Communicating any changes, delays, or safety decisions as soon as reasonably practicable.
- Avoiding misleading statements about Trip outcomes, pricing, cancellations, or refunds.
You acknowledge that communication quality affects Customer trust and may affect reviews, dispute rates, and Platform standing.
13.2 Prohibited Conduct and Harassment
You may not use the Platform or Platform communications to engage in harassment, threats, discrimination, abusive conduct, or unlawful behavior. Prohibited conduct includes:
- Threatening language or intimidation.
- Harassment, stalking, or unwanted repeated contact.
- Discriminatory statements or refusal of service based on protected characteristics except where lawful and safety-based limitations apply.
- Sexual harassment or inappropriate communications.
- Profanity or abusive language directed at Customers or Platform staff.
- Retaliation against Customers for complaints, disputes, or reviews.
The Platform may take immediate enforcement action where necessary to protect safety or integrity.
13.3 No Spam, Solicitation, or Unrelated Promotions
You may not use Platform messaging tools to send spam or promotional messages unrelated to a specific Booking or listing inquiry. You may not:
- Advertise unrelated products or services.
- Send mass messages for marketing purposes outside Platform-approved features.
- Send misleading promotional offers designed to move Customers off-platform.
Any attempt to solicit off-platform bookings or payments is prohibited and may be treated as circumvention under these Terms.
13.4 Communications Accuracy and Recordkeeping
You are responsible for the accuracy of statements you make to Customers. You agree not to:
- Misrepresent cancellation or refund rules.
- Promise refunds or credits outside the policy disclosed at checkout unless you intend to honor them.
- Misrepresent Vessel condition, capacity, insurance, licensing status, or Trip inclusions.
Where a dispute arises, communications may be used to evaluate whether you complied with these Terms and with the Listing disclosures.
13.5 Platform Rights to Retain and Review Communications
Reel Adventure Booking may retain communications conducted through Platform tools for a reasonable period for operational, safety, fraud prevention, dispute resolution, and legal compliance purposes. The Platform may access or review communications where reasonably necessary to:
- Investigate suspected fraud, circumvention, or misuse.
- Respond to safety complaints or allegations of misconduct.
- Address disputes, chargebacks, or booking conflicts.
- Comply with legal requests or regulatory requirements.
- Enforce these Terms and Platform policies.
The Platform does not guarantee that it will monitor communications in real time and does not assume responsibility for communications between you and Customers.
13.6 Off-Platform Communications
If you choose to communicate with Customers off the Platform, you do so at your own risk. Off-platform communications may reduce the Platform's ability to assist with disputes and may increase the likelihood of misunderstandings regarding Trip terms, cancellations, or payment structure.
You remain bound by the non-circumvention rules in these Terms regardless of where communications occur.
13.7 Reporting Issues and Cooperation
If a Customer reports harassment, threats, unsafe behavior, or other serious concerns, you agree to cooperate with Platform requests for information and to provide accurate statements regarding the incident. Failure to cooperate may result in account restrictions or termination.
14. Ratings, Reviews, and Reputation Management
The Platform may allow Customers to submit ratings, reviews, and feedback regarding Trips, Captains, and Operators. Ratings and reviews help Customers make informed decisions and help maintain marketplace quality. You agree to engage with the review system honestly and professionally.
14.1 Eligibility and Scope of Reviews
Reviews may be limited to Customers who completed a confirmed Booking through the Platform or otherwise meet eligibility rules established by the Platform. Reviews may relate to Trip quality, professionalism, communication, safety practices, and overall experience.
You acknowledge that reviews reflect individual opinions and may vary based on weather, fishing conditions, and customer expectations.
14.2 Review Integrity and Prohibited Manipulation
You may not manipulate the review system. Prohibited conduct includes:
- Offering money, discounts, free add-ons, or other incentives in exchange for positive reviews.
- Threatening Customers or pressuring them to remove or change reviews.
- Retaliating against Customers for leaving negative reviews or for filing complaints.
- Posting fake reviews or arranging reviews from individuals who did not complete the Trip.
- Coordinating review brigading or any effort to artificially inflate ratings.
Any attempt to influence reviews through coercion, compensation, or deception may result in enforcement action.
14.3 Captain Responses to Reviews
Where the Platform permits responses, you may respond to reviews in a professional and respectful manner. Responses must comply with these Terms and must not:
- Disclose personal information of a Customer.
- Include threats, insults, harassment, or discriminatory statements.
- Misrepresent facts in a manner intended to deceive other users.
- Include off-platform solicitation or marketing unrelated to the review.
You acknowledge that your responses may be publicly visible and may affect Customer trust.
14.4 Requests to Remove or Modify Reviews
Reel Adventure Booking may, but is not required to, remove or restrict reviews that violate Platform rules or applicable law. You may request review removal only if you reasonably believe the review:
- Contains hate speech, threats, or harassment.
- Discloses private information.
- Is demonstrably false and materially misleading.
- Is submitted by someone who did not participate in the Trip.
- Is extortionate or retaliatory in nature.
The Platform may require supporting documentation and may deny removal requests where the review appears to reflect a genuine experience or opinion.
14.5 Platform Moderation Rights
Reel Adventure Booking reserves the right, but does not have an obligation, to review, screen, edit, suppress, or remove reviews and related content to:
- Enforce these Terms and review integrity policies.
- Reduce fraud, abuse, or harassment.
- Comply with legal obligations.
- Maintain marketplace quality.
The Platform may also take action on accounts that show patterns of customer complaints, unusually high dispute rates, or repeated safety concerns.
14.6 No Guarantee of Publication or Ranking Impact
The Platform does not guarantee that any review will be published or remain posted indefinitely. The Platform may adjust how ratings and reviews are displayed and may use review and performance metrics to influence listing visibility, search ranking, eligibility for features, or access to promotional tools.
15. Data Use, Document Storage, and Retention
To operate the Platform, verify compliance, and protect Customers, Reel Adventure Booking may collect, store, and process certain documents and information submitted by Captains and Operators, including identity verification status, licensing credentials, vessel registration documents, and insurance documentation. You acknowledge that submission of these materials is a condition of listing Trips and accepting Bookings through the Platform.
15.1 Categories of Data and Documents Collected
You may be required to submit, and the Platform may store, information and documents including:
- Captain licensing credentials, including Merchant Mariner Credential and related endorsements.
- Vessel registration documentation, ownership or operational authority documentation, and vessel specifications.
- Certificates of insurance, declarations pages, and related coverage confirmations.
- Business registration information and tax or compliance information where applicable.
- Identity verification status information, including Stripe Identity verification results and verification timestamps.
- Communications with Customers through Platform messaging tools.
- Booking and Trip records, including pricing, cancellation outcomes, and dispute records.
You represent and warrant that documents you submit are accurate, complete, and authentic.
15.2 Purposes for Collection and Use
Reel Adventure Booking may use the information and documents described in this section for purposes including:
- Identity verification and eligibility determination.
- Administrative screening for listing approval and marketplace safety.
- Customer support, dispute resolution, and investigation of complaints.
- Fraud prevention, chargeback management, and platform integrity monitoring.
- Compliance with legal obligations and enforcement of these Terms.
- Operational communications relating to Bookings, cancellations, and Trip status.
You acknowledge that the Platform's review is administrative in nature and does not constitute regulatory approval or legal compliance assurance.
15.3 Storage and Security Measures
Reel Adventure Booking maintains administrative, technical, and organizational safeguards designed to protect stored documents and personal information from unauthorized access, misuse, or disclosure. However, no system can be guaranteed to be completely secure.
You agree to:
- Submit documents only through approved Platform channels.
- Avoid sending sensitive documents through unencrypted third-party messaging tools unless expressly instructed.
- Maintain security of your own devices and account credentials.
If you suspect unauthorized access to your account or uploaded documents, you agree to notify the Platform promptly.
15.4 Access Controls and Confidentiality
Access to stored captain and vessel documents is limited to personnel and service providers who need access for legitimate operational, compliance, safety, or dispute resolution purposes.
Reel Adventure Booking may share certain information with third-party service providers, including Stripe, hosting providers, and compliance vendors, solely to provide Platform services and subject to contractual confidentiality and data protection obligations.
15.5 Sharing With Customers and Third Parties
The Platform may share limited information with Customers necessary to facilitate Trips, including:
- Your business name and listing information.
- Departure location, meeting instructions, and Trip-related requirements.
- Limited contact information where necessary for operational coordination.
The Platform does not share your complete licensing documents or insurance policy documents with Customers unless you separately choose to provide them or unless disclosure is required by law or necessary to address a safety incident.
The Platform may disclose information where required by legal process, regulatory request, or to protect the rights, safety, and property of the Platform, Customers, Captains, or the public.
15.6 Retention Periods
Reel Adventure Booking retains documents and data for as long as reasonably necessary to:
- Operate the Platform and maintain your account.
- Maintain marketplace integrity and safety standards.
- Provide customer support and resolve disputes.
- Comply with legal obligations, audit needs, and enforcement requirements.
Retention periods may vary by data type and may extend beyond the duration of your account, especially for records related to Bookings, payouts, disputes, chargebacks, fraud prevention, and legal compliance.
15.7 Updates, Renewals, and Historical Records
You acknowledge that the Platform may retain historical versions of documents, including expired insurance certificates or prior credential submissions, for audit, dispute resolution, and compliance purposes.
You remain responsible for uploading renewed or updated documents promptly. Failure to keep documents current may result in Listing suspension or other enforcement actions.
15.8 Deletion Requests and Limitations
If you request account deletion, Reel Adventure Booking may delete or de-identify certain personal information where feasible. However, you acknowledge and agree that the Platform may retain:
- Booking transaction records.
- Payout and payment records.
- Dispute and chargeback records.
- Compliance and verification audit records.
- Safety incident records.
Such retention may be necessary to comply with legal obligations, respond to regulators, defend claims, prevent fraud, and enforce these Terms.
16. Insurance and Risk Allocation
You are solely responsible for all risks associated with operating your Vessel, conducting Trips, carrying passengers, and providing charter services. Reel Adventure Booking does not provide insurance coverage for you, your business, your crew, your Vessel, or your passengers.
16.1 Sole Responsibility for Trip Operations
You acknowledge and agree that:
- You control and operate all Trips listed on the Platform.
- You are solely responsible for Vessel operation, navigation, safety decisions, and passenger management.
- You determine whether conditions are safe to depart, continue, modify, or cancel a Trip.
- You are responsible for your crew, agents, contractors, and any person assisting in Trip operations.
Reel Adventure Booking does not supervise or direct your Trip operations and does not assume responsibility for your acts or omissions.
16.2 No Platform Insurance Coverage
Reel Adventure Booking does not:
- Provide vessel insurance.
- Provide passenger or customer accident insurance.
- Provide general liability coverage for your charter business.
- Provide workers compensation or crew coverage.
- Provide protection and indemnity coverage.
You must not represent to Customers or third parties that the Platform provides insurance coverage for your operations.
16.3 Your Obligation to Maintain Adequate Insurance
You are responsible for obtaining and maintaining all insurance coverage required by law and appropriate for prudent charter operations. This includes coverage for:
- Vessel and hull risks.
- Passenger and third-party liability.
- Charter business liability.
- Crew and employee risks where applicable.
You agree that you will not operate or list Trips during any lapse, suspension, or cancellation of required insurance coverage.
16.4 No Guarantee of Coverage or Claims Outcome
You acknowledge that:
- Insurance policies contain exclusions, limits, and conditions.
- Not all incidents, losses, or claims may be covered.
- Coverage determinations are made by your insurer.
Reel Adventure Booking does not guarantee that any loss, injury, damage, or claim will be covered by your insurance policy.
16.5 Allocation of Risk Between You and the Platform
To the maximum extent permitted by law:
- You assume all risks arising from your Trip operations.
- You are responsible for claims, injuries, losses, damages, fines, and liabilities arising from your Vessel, crew, passengers, or operations.
- Reel Adventure Booking is not liable for operational incidents, safety failures, regulatory violations, or customer injuries arising from your Trips.
16.6 Emergency Situations and Medical Events
You acknowledge that emergency response capabilities on the water are limited. You are responsible for:
- Carrying required safety and emergency equipment.
- Providing safety briefings to passengers.
- Taking reasonable action to seek emergency assistance when necessary.
Reel Adventure Booking does not provide medical or rescue services and is not responsible for emergency response outcomes.
17. Indemnification
You agree to indemnify, defend, and hold harmless Reel Adventure Booking, its owners, officers, directors, employees, agents, affiliates, and representatives from and against any claims, demands, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of the Platform as a Captain or Operator.
- Any Trip you list, offer, or conduct.
- Operation of any Vessel listed on the Platform.
- Acts or omissions of you, your crew, employees, contractors, or agents.
- Injury, death, or property damage involving passengers or third parties.
- Your violation of these Terms or any Platform policy.
- Your violation of any law, regulation, licensing requirement, or safety rule.
- Misrepresentation of licensing, insurance, Vessel condition, or Trip details.
- Disputes, chargebacks, or refund claims arising from your Trips.
- Any off-platform payment or circumvention activity.
This indemnification obligation includes claims brought by:
- Customers or passengers.
- Crew members or employees.
- Other Captains or Operators.
- Marina operators or port authorities.
- Government or regulatory agencies.
- Insurance carriers or third-party service providers.
17.1 Defense and Cooperation
Reel Adventure Booking may, at its option, assume control of the defense of any matter subject to indemnification. If so, you agree to cooperate fully, provide information, and assist as reasonably requested.
You may not settle any claim in a manner that imposes liability, admission, or obligation on Reel Adventure Booking without prior written consent.
17.2 Survival
Your indemnification obligations survive termination of your account, completion of Trips, and termination of these Terms.
18. Liability Allocation
You acknowledge and agree that Reel Adventure Booking provides a marketplace and technology platform only. The Platform does not operate Vessels, conduct Trips, employ Captains, or supervise on-water activities. This section allocates risk and liability between you and the Platform.
18.1 Responsibility for Your Operations
You are solely responsible for:
- All Trip operations and on-water activities.
- Vessel navigation, maintenance, and seaworthiness.
- Passenger safety and supervision.
- Crew conduct and training.
- Compliance with laws, licensing requirements, and safety regulations.
- All representations made in Listings and communications.
Reel Adventure Booking does not control or direct your operations and does not assume liability for your acts or omissions.
18.2 Platform Provided As Is
The Platform and all related services are provided on an as is and as available basis. To the maximum extent permitted by law, Reel Adventure Booking disclaims all warranties, express or implied, including:
- Merchantability.
- Fitness for a particular purpose.
- Non-infringement.
- Accuracy or reliability of Platform functions.
- Availability or uninterrupted operation.
The Platform does not guarantee booking volume, revenue, payout timing, or Listing visibility.
18.3 Limitation of Platform Liability
To the maximum extent permitted by law, Reel Adventure Booking is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to:
- Your use of or inability to use the Platform.
- Any Listing, Booking, or Trip.
- Payment processing, payout delays, reserves, or Stripe decisions.
- Disputes, chargebacks, or refund outcomes.
- Communications with Customers.
- Safety incidents, injuries, deaths, or property damage.
- Regulatory enforcement or licensing consequences.
18.4 Liability Cap
To the maximum extent permitted by law, Reel Adventure Booking's total liability to you for any claim arising out of or related to these Terms or the Platform will not exceed the total Platform fees retained by Reel Adventure Booking from your Bookings in the twelve month period preceding the event giving rise to the claim.
Some jurisdictions do not permit limitation of liability in all circumstances. Where such limitations are restricted, liability is limited to the fullest extent permitted by law.
18.5 No Liability for Third-Party Services
The Platform integrates third-party services including Stripe, hosting providers, mapping services, and communication tools. Reel Adventure Booking is not responsible for:
- Stripe onboarding decisions or verification outcomes.
- Payout delays, holds, reserves, or account restrictions.
- Payment declines or issuer decisions.
- Third-party service outages or errors.
Your use of third-party services may be subject to separate terms and policies.
18.6 No Liability for Business Loss
Reel Adventure Booking is not liable for loss of income, lost bookings, reputational impact, business interruption, or opportunity loss arising from:
- Listing suspension or removal.
- Account verification delays.
- Platform outages.
- Customer cancellations.
- Disputes or chargebacks.
18.7 Exceptions Where Liability Cannot Be Excluded
Nothing in these Terms limits or excludes liability for:
- Fraud or intentional misrepresentation.
- Willful misconduct.
- Liability that cannot be limited under applicable law.
19. Termination and Suspension
Reel Adventure Booking may suspend or terminate your access to the Platform, your Listings, or your payout functionality when necessary to protect Customers, maintain marketplace integrity, comply with legal obligations, or enforce these Terms.
19.1 Termination by You
You may stop using the Platform at any time. Where account deletion tools are available, you may request account closure through your dashboard or by contacting Platform support.
Termination of your account does not:
- Cancel existing confirmed Bookings.
- Relieve you of obligations to perform confirmed Trips.
- Relieve you of refund, dispute, or chargeback responsibilities.
- Eliminate payment obligations owed to the Platform.
You remain responsible for properly handling any confirmed Trips or cancellations in accordance with your disclosed cancellation policies.
19.2 Suspension or Termination by the Platform
Reel Adventure Booking may suspend or terminate your account, Listings, or Platform access if it reasonably determines that:
- You violated these Terms or Platform policies.
- You failed identity, licensing, or insurance verification requirements.
- Your credentials or documents are expired, invalid, or misleading.
- You engaged in circumvention or off-platform payment conduct.
- You have excessive cancellations, disputes, or chargebacks.
- You misrepresented Trips, pricing, or vessel information.
- You engaged in unsafe, abusive, or unlawful conduct.
- Continued operation creates legal, safety, or reputational risk.
- Stripe or payment providers restrict or terminate your payout account.
Where practicable, notice will be provided. Immediate suspension may occur where necessary to prevent harm, fraud, or safety risks.
19.3 Effect on Listings and Pending Bookings
If your account is suspended or terminated:
- Active Listings may be removed or hidden.
- New Bookings may be blocked.
- Confirmed upcoming Trips may be canceled where necessary to protect Customers.
- Customers may receive refunds according to disclosed cancellation terms and applicable law.
You remain responsible for refund obligations and dispute handling arising from your Trips, including those affected by account suspension or termination.
19.4 Effect on Payouts
If your account is suspended or terminated:
- Stripe or the Platform may delay or withhold payouts as permitted by Stripe policies and applicable law.
- Funds may be reserved to cover refunds, chargebacks, disputes, or unresolved liabilities.
- You remain responsible for negative balances or outstanding refund obligations.
Reel Adventure Booking does not guarantee payout release timing after termination, as Stripe controls settlement and compliance processes.
19.5 Post-Termination Cooperation
After termination, you agree to cooperate with reasonable Platform requests related to:
- Refund processing.
- Dispute and chargeback resolution.
- Safety incident investigations.
- Legal or regulatory inquiries.
19.6 Survival of Provisions
The following sections survive termination:
- Indemnification
- Liability Allocation
- Data Use and Document Retention
- Dispute Resolution
- Any payment, refund, or dispute obligations
- Any provisions intended by their nature to survive
20. Dispute Resolution and Governing Law
This section governs how disputes relating to the Platform, these Terms, and your Listings or Bookings are handled. Please read it carefully.
20.1 Informal Resolution First
Before initiating any legal proceeding, you agree to first contact Reel Adventure Booking through Platform support channels to attempt informal resolution. You agree to provide a written description of the issue and allow a reasonable time for review and response.
20.2 Governing Law
These Terms, your use of the Platform, and any dispute arising out of or relating to these Terms, Listings, Bookings, or Trip operations facilitated through the Platform will be governed by and construed in accordance with the laws of the State where Reel Adventure Booking is organized, without regard to conflict of law principles.
The governing jurisdiction may be specified in the final published version of these Terms if required for regulatory or operational purposes.
20.3 Jurisdiction and Venue
Except where arbitration is required or elected by the Platform, any legal action or proceeding must be brought in the state or federal courts located in the governing state. You consent to personal jurisdiction and waive any objection based on inconvenient forum.
20.4 Arbitration Option
Where permitted by applicable law, Reel Adventure Booking may require certain disputes to be resolved through binding arbitration rather than court litigation. If arbitration applies, the arbitration process and rules will be disclosed in the final version of these Terms or in a separate arbitration agreement.
20.5 No Class Actions
To the maximum extent permitted by law, disputes must be brought on an individual basis only. You agree not to bring or participate in class actions, collective actions, or representative proceedings against Reel Adventure Booking relating to these Terms or the Platform.
20.6 Injunctive Relief
Nothing in this section prevents Reel Adventure Booking from seeking injunctive or equitable relief to prevent fraud, circumvention, intellectual property misuse, or unauthorized Platform access.
21. Modifications to These Terms
Reel Adventure Booking may revise these Terms from time to time to reflect Platform changes, legal requirements, or business practices. When revisions occur, the Effective Date at the top of this document will be updated.
If changes are material, notice may be provided through the Platform, dashboard notifications, or email. Your continued use of the Platform after revised Terms are posted constitutes acceptance of the updated Terms.
If you do not agree to revised Terms, you must discontinue use of the Platform and stop listing or accepting new Bookings. Existing confirmed Bookings remain governed by the Terms in effect at the time of confirmation unless otherwise required by law.
22. Miscellaneous Provisions
22.1 Entire Agreement
These Terms, together with any Platform policies, Listing disclosures, payout disclosures, and incorporated documents, constitute the entire agreement between you and Reel Adventure Booking concerning your use of the Platform as a Captain or Operator and supersede any prior agreements or understandings.
22.2 Severability
If any provision of these Terms is held unlawful or unenforceable, that provision will be severed to the minimum extent necessary and the remaining provisions will remain in full force.
22.3 No Waiver
Failure by Reel Adventure Booking to enforce any provision does not constitute a waiver of that provision. Any waiver must be in writing and signed by an authorized representative.
22.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent. Reel Adventure Booking may assign these Terms in connection with merger, acquisition, corporate reorganization, asset sale, or operation of law.
22.5 Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Reel Adventure Booking. You have no authority to bind the Platform in any manner.
22.6 Notices
Notices to you may be provided through the Platform, email, or other reasonable means using your account contact information. Notices to Reel Adventure Booking may be delivered through the support or contact channels published on the Platform.
