Customer Booking Terms & Conditions

Effective Date: February 9, 2026

These Customer Booking Terms and Conditions (these "Terms") govern your access to and use of the Reel Adventure Booking website, mobile interfaces, and related services (collectively, the "Platform") to browse, request, and book fishing charter trips and related experiences offered by independent captains and operators (each, a "Captain" or "Operator").

By clicking "I agree," creating an account, submitting a booking request, completing a checkout, or otherwise accessing or using the Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Platform.

1. Platform Operator

The Platform is operated by Reel Adventure Booking (the "Company," "Reel Adventure Booking," "we," "us," or "our"). These Terms form a legally binding agreement between you and the Company.

2. Definitions

For clarity, the following terms have the meanings set forth below. Additional defined terms may appear elsewhere in these Terms.

  • Booking: A reservation request or confirmed reservation for a Trip made through the Platform.
  • Captain / Operator: The independent boat owner, captain, charter business, or other trip provider offering a Trip on the Platform.
  • Customer, you, your: Any individual who accesses the Platform or books a Trip through the Platform, whether for themselves or for other passengers.
  • Trip: A fishing charter trip or other on-water experience listed by a Captain or Operator on the Platform.
  • Deposit: A partial payment, commonly twenty percent (20%) of the Trip price unless otherwise stated at checkout, made to hold or confirm a Booking.
  • Full Payment: Payment of the entire Trip price through the Platform at checkout.
  • Remaining Balance: Any portion of the Trip price not paid through the Platform at the time of checkout, including amounts due later online, if available, or in person to the Captain or Operator, as disclosed at the time of booking.
  • Stripe: Stripe, Inc. and its affiliates, including Stripe payment processing, Stripe Connect, and Stripe Identity services, as applicable.
  • Scheduled Auto-Pay: An optional feature that, when available for a Trip and selected by you, permits Stripe to attempt to charge the Remaining Balance automatically on a scheduled date using a stored Stripe reference to your selected payment method.

3. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the Effective Date above and may provide notice through the Platform. Your continued access to or use of the Platform after updated Terms are posted constitutes acceptance of the updated Terms.

4. Relationship to Other Policies

These Terms must be read together with our Privacy Policy and any additional policies or disclosures presented at checkout or within the booking flow, including Trip-specific cancellation and refund terms.

If a Trip-specific disclosure shown at checkout conflicts with these Terms, the Trip-specific disclosure will control for that Booking to the extent of the conflict.

5. Eligibility to Use the Platform

You may use the Platform only if:

  • You are at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, and able to enter into a binding contract.
  • You provide accurate, current, and complete information when creating an account and when booking a Trip.
  • You comply with these Terms and all applicable laws and regulations.

If you book on behalf of other passengers, you represent that you have authority to accept these Terms for all passengers and that all passengers will follow Trip requirements and safety instructions.

6. Geographic Scope and Availability

The Platform may be accessed globally. Trips listed on the Platform are offered by Captains and Operators for departures within the United States only, unless explicitly stated otherwise. Availability of Trips, payment options including Scheduled Auto-Pay, and Platform features may vary by Trip, location, and other factors.

7. Important Notices

The following summary is provided for convenience only. The full Terms govern.

  • Reel Adventure Booking is a booking platform and does not own or operate vessels or provide fishing charter services.
  • Captains and Operators are independent third parties responsible for Trip operations, safety, licensing, and insurance.
  • Payments are processed through Stripe. Depending on the Trip, you may pay a Deposit, Full Payment, and/or Remaining Balance. Some Remaining Balances may be paid in person to the Captain or Operator when online payment is not available.
  • Certain Trips may offer Scheduled Auto-Pay for Remaining Balances. If a Scheduled Auto-Pay charge fails, the feature may be disabled and you remain responsible for payment by another method.
  • Fishing and boating involve inherent risks. You are responsible for following all safety instructions and ensuring your party meets Trip requirements.

8. Platform Role and Nature of Services

Reel Adventure Booking operates an online marketplace platform that enables Customers to discover, request, and book fishing charter trips offered by independent Captains and Operators. The Platform provides technology, listing tools, booking functionality, and payment processing integration. The Platform does not own, manage, control, or operate any vessel, equipment, or Trip, and does not employ or supervise Captains or Operators.

Captains and Operators are independent business entities solely responsible for offering, conducting, and delivering Trips. Each Captain or Operator is responsible for maintaining all required licenses, permits, credentials, registrations, and insurance necessary to lawfully operate their business and conduct Trips. The Platform does not guarantee the legality, quality, safety, or suitability of any Trip or Captain.

When you make a Booking through the Platform, you enter into a direct agreement with the Captain or Operator for the provision of the Trip. Reel Adventure Booking is not a party to that service agreement, except to the limited extent necessary to facilitate the booking, process payments, and provide customer support related to the Platform.

The Platform may provide communication tools that allow Customers and Captains to exchange messages regarding a Booking. These tools are provided for convenience only. The Platform does not monitor, control, or guarantee the content, accuracy, or reliability of communications between Customers and Captains.

The Platform may suspend, restrict, or remove listings or user accounts that violate Platform policies or applicable law. However, such actions do not create any duty to supervise or guarantee the conduct of any Captain, Operator, or Customer.

You acknowledge and agree that participation in fishing and boating activities involves inherent risks. The Platform does not assume responsibility for personal injury, property damage, loss, delay, cancellation, or other harm arising from any Trip, except as expressly stated in these Terms.

9. Eligibility and Account Registration

You may access and use the Platform only if you meet the eligibility requirements stated in these Terms and you are able to enter into a legally binding agreement. By creating an account, using the Platform, or making a Booking, you represent and warrant that you satisfy all eligibility requirements and that you will use the Platform in compliance with these Terms and all applicable laws.

9.1 Minimum Age and Capacity

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to create an account or book a Trip through the Platform. By using the Platform, you represent that you have the legal capacity to enter into these Terms and to form a binding contract with Reel Adventure Booking and, for Trips you book, with the applicable Captain or Operator.

If you are booking a Trip for a group, you are responsible for ensuring that all members of your party meet the minimum age requirements imposed by the Captain or Operator and comply with any Trip-specific rules, safety requirements, or limitations disclosed on the listing page or during checkout.

9.2 Account Creation and Required Information

To access certain features of the Platform, you may be required to create an account. When you create an account, you agree to provide information that is accurate, current, and complete. You also agree to promptly update your account information if it changes.

You may not impersonate another person, create an account using false or misleading information, or use another person's account without authorization.

9.3 Account Security and Responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to take reasonable steps to safeguard your password and to notify Reel Adventure Booking promptly if you suspect unauthorized access to your account or any security breach.

Reel Adventure Booking is not responsible for any loss or damage resulting from your failure to protect your account credentials or from unauthorized use of your account, except to the extent such loss or damage is caused by our failure to implement reasonable administrative, technical, and physical safeguards for the Platform.

9.4 One Account Per User and Account Restrictions

Unless expressly permitted by Reel Adventure Booking, you may not create multiple accounts for the purpose of circumventing restrictions, avoiding enforcement actions, or abusing promotions, discounts, or referral programs. We may suspend, restrict, or terminate accounts that we reasonably believe are created or used in violation of these Terms.

9.5 Communications and Notices

By creating an account and providing contact information, you consent to receive transactional communications related to your account and Bookings, including confirmations, reminders, updates, receipts, and notices concerning changes to your Trip or payment status. These communications may be sent by email, text message, or through the Platform, depending on your preferences and the features available.

You are responsible for keeping your contact information current. If you fail to provide accurate contact information, you may miss important Trip updates, cancellation notices, or payment-related notifications.

Marketing communications are addressed separately in these Terms and in our Privacy Policy, and you may opt out of non-transactional marketing messages as described therein.

9.6 Prohibited Use Related to Accounts

You agree not to do any of the following in connection with your account or Platform use:

  • Use the Platform for unlawful purposes or in violation of applicable laws.
  • Attempt to gain unauthorized access to other user accounts, Platform systems, or data.
  • Interfere with, disrupt, or degrade the Platform, including by introducing malware, automated scraping, or excessive requests.
  • Use bots, scripts, or automated means to access the Platform or to book Trips unless expressly authorized.
  • Submit false information, fraudulent payment methods, or misleading identity details.

Reel Adventure Booking may take reasonable actions to investigate suspected violations, including suspension of account access, cancellation of Bookings, and cooperation with law enforcement where required or appropriate.

9.7 Booking on Behalf of Others

If you make a Booking on behalf of other passengers, you represent and warrant that:

  • You have authority to accept these Terms for all passengers in your party.
  • You have permission to provide any information you submit on their behalf.
  • You will communicate Trip details, cancellation terms, safety requirements, and Captain instructions to all passengers.
  • You will be responsible for the conduct of your party during the Trip and for ensuring compliance with Captain requirements and applicable law.

10. Trip Listings and Booking Process

The Platform provides a marketplace where Captains and Operators may publish Trip listings and Customers may browse available Trips and submit Booking requests. Each listing may include Trip descriptions, departure location, duration, target species, included items, capacity, pricing, cancellation terms, and other Trip-specific requirements or restrictions.

Trip listings are created and maintained by Captains and Operators, and the Platform does not guarantee that any listing is complete, accurate, or up to date.

10.1 Trip Information and Listing Content

Trip listings and related content are provided for informational purposes and to facilitate Bookings. Captains and Operators are responsible for ensuring that their listings are accurate, lawful, and consistent with their capabilities and equipment. Trip details may change due to weather, safety, seasonal availability, maintenance, licensing constraints, crew availability, or other operational factors.

You acknowledge and agree that fishing and boating conditions may vary and that outcomes, including the ability to fish, travel, or catch fish, are not guaranteed. Any examples, images, descriptions, catch photos, or statements of expectations are illustrative only and do not create a promise or warranty regarding your Trip experience.

10.2 Booking Requests, Confirmation, and Reservation Status

A Booking is not confirmed until the Platform indicates that the Booking is confirmed and, where applicable, the required payment has been successfully processed. Depending on the Trip, the Platform may support:

  • Immediate confirmation at checkout.
  • A request and acceptance model where the Captain or Operator must accept the Booking request before it is confirmed.
  • Conditional confirmations based on final availability checks, trip minimums, capacity, or other listing requirements.

If a Booking is not confirmed, you do not have a right to the Trip, and you should not make non-refundable travel arrangements based on an unconfirmed Booking.

10.3 Availability, Scheduling, and Changes

Availability shown on the Platform is an estimate based on information provided by Captains and Operators and Platform logic. Availability may change at any time, including during checkout. Captains and Operators may also impose additional restrictions or requirements, such as arrival time, passenger limits, minimum age, or licensing compliance, which will be disclosed in the listing or communicated through the Platform.

After a Booking is confirmed, changes to a Trip date, time, departure location, or other material terms may require Captain approval and may be subject to cancellation terms, rescheduling rules, and any applicable fees disclosed during the booking flow.

10.4 Customer Responsibility to Review Trip Requirements

Before submitting a Booking request or completing checkout, you are responsible for reviewing all Trip information provided on the listing and at checkout, including:

  • Trip date, time, and location.
  • Total price and payment structure, including whether a Deposit, Full Payment, and/or Remaining Balance applies.
  • Cancellation and refund terms.
  • Capacity limitations and passenger requirements.
  • What is included and what you must bring, including licensing, gear, and attire.
  • Any rules regarding alcohol, smoking, prohibited items, or conduct.
  • Any safety requirements, waivers, or conditions imposed by the Captain or Operator.

If you have questions about a Trip, you should communicate with the Captain or Operator through the Platform before booking. You are responsible for ensuring the Trip fits your needs, including accessibility requirements, medical considerations, and skill level.

10.5 Shared-Seat, Group, and Capacity Bookings

Certain Trips may be offered as shared-seat experiences, per-person bookings, or capacity-limited bookings where the Trip may be shared with other Customers. For these Trips:

  • Capacity is limited and may sell out quickly.
  • The Platform may use availability checks, payment authorization holds, and payment capture logic to reduce the risk of overbooking.
  • In certain cases, the Platform may authorize your payment method but delay capture until a final availability check is completed.

If the Trip sells out or becomes unavailable during checkout, the Platform will attempt to avoid capturing payment. If payment has been captured, the Platform will initiate a refund consistent with these Terms and the cancellation and refund rules shown at checkout. You acknowledge that timing of reversals and refunds may depend on Stripe and your financial institution.

10.6 Booking Errors and Corrections

If you believe there is an error in your Booking, you must notify Reel Adventure Booking promptly through the Platform support channels. While we may assist with facilitating communication or correcting Platform-related errors, we cannot guarantee that a Trip can be modified after confirmation, particularly when the Captain has operational constraints or when the request is made close to the Trip date.

You are responsible for verifying your Booking details immediately after confirmation, including passenger count, date, time, and departure location. Failure to timely review Booking details may result in missed departures, forfeited payments under no-show policies, or other consequences.

10.7 Right to Refuse or Cancel Bookings for Platform Integrity

To protect the Platform, Captains, and Customers, Reel Adventure Booking may refuse, suspend, or cancel a Booking if we reasonably believe that:

  • The Booking involves fraud, stolen payment methods, chargeback risk, or unlawful activity.
  • The Booking violates these Terms or applicable law.
  • The Customer has engaged in abusive, threatening, or unsafe behavior.
  • The Booking appears to be made for commercial resale, unauthorized third-party use, or other improper purpose.
  • Platform integrity or security would be compromised by completing the Booking.

If a Booking is canceled by Reel Adventure Booking under this section for a legitimate integrity or security concern, we will handle any payments in a manner consistent with applicable law and the policies disclosed at checkout, and we may provide notice to the Captain or Operator as appropriate.

10.8 No Guarantee of Trip Outcomes

Fishing is unpredictable, and Trip results vary based on environmental conditions, fish behavior, weather, tides, water conditions, equipment, and other factors. Reel Adventure Booking does not guarantee any particular outcome, including a specific catch quantity, species, route, fishing location, duration in a specific area, or overall experience.

Dissatisfaction with Trip outcomes that are inherent to fishing and boating does not entitle you to a refund unless expressly provided in the cancellation policy shown at checkout.

11. Pricing and Fees

Trip prices displayed on the Platform are set by Captains and Operators and are subject to the payment structure, fees, and terms disclosed in the Trip listing and during checkout. The total amount you pay, the timing of your payments, and whether you owe a Remaining Balance later will depend on the specific Trip and the options selected during the booking flow.

11.1 Displayed Prices and What They Represent

Trip listings may display pricing in different formats depending on the Trip, including:

  • A total Trip price for a private charter.
  • A per-person price for shared-seat or group-capacity Trips.
  • A price based on passenger count, duration, seasonality, or other Trip parameters.

Displayed pricing may reflect base pricing only and may not include applicable taxes, government fees, dockage fees, marina fees, fuel surcharges, gratuities, optional add-ons, or other charges that may apply. Any additional charges that will be collected through the Platform will be disclosed during checkout before you authorize payment.

Captains and Operators are responsible for accurately describing what is included in the Trip price, such as fuel, bait, tackle, ice, licensing guidance, cleaning services, or other inclusions, and for disclosing any additional charges or exclusions.

11.2 Platform Fees

Reel Adventure Booking may charge a service fee, booking fee, or other platform fee in connection with your use of the Platform and the booking services provided. If a platform fee applies to your Booking, it will be disclosed in the checkout flow before you complete payment.

Platform fees may vary by Trip, booking type, location, promotional campaigns, or other factors. Unless expressly stated otherwise at checkout, platform fees are non-refundable to the extent permitted by law, except where a refund is required due to cancellation by the Captain, cancellation by the Platform for reasons attributable to the Platform, or other circumstances where applicable law requires a refund.

11.3 Taxes and Government Charges

Trip prices may be subject to applicable sales tax, excise tax, tourism taxes, local fees, or other government charges depending on the jurisdiction and the nature of the Trip. Where the Platform is required to collect and remit taxes, such taxes will be presented during checkout.

In some cases, the Captain or Operator may be responsible for collecting and remitting taxes directly, including taxes collected outside the Platform through in-person Remaining Balance payments. Reel Adventure Booking does not provide tax advice, and you are responsible for reviewing the price breakdown and any tax information presented at checkout.

11.4 Optional Add-Ons, Extras, and Third-Party Purchases

Certain Trips may offer optional add-ons, upgrades, or extras, such as additional hours, equipment upgrades, transportation assistance, food packages, or other services. If optional items are offered through the Platform, their pricing and payment terms will be disclosed before you complete checkout.

If the Captain or Operator offers optional purchases outside the Platform, including in-person purchases on the day of the Trip, those purchases are made directly with the Captain or Operator and are not processed by Reel Adventure Booking unless expressly stated. The Platform is not responsible for pricing, performance, or refunds for purchases made outside the Platform.

11.5 Promotional Credits, Discounts, and Referral Programs

From time to time, the Platform may offer promotional discounts, referral credits, coupon codes, or similar incentives. Unless expressly stated otherwise:

  • Promotions may be subject to additional terms and may be limited to certain Trips, time periods, or user accounts.
  • Promotional credits have no cash value and may not be transferred, sold, or redeemed for cash.
  • We may modify, suspend, or terminate promotions at any time, subject to applicable law.
  • Misuse of promotions, including creating multiple accounts to obtain benefits or applying discounts in a fraudulent manner, may result in cancellation of the Booking, forfeiture of promotional benefits, and suspension or termination of your account.

11.6 Currency and Payment Amount Authorization

All prices are displayed in U.S. dollars unless explicitly stated otherwise. When you submit payment information and authorize a transaction, you authorize the Platform and Stripe to charge the applicable payment method for the total amount shown during checkout, including any taxes and disclosed fees.

If your financial institution imposes additional fees, currency conversion costs, or international transaction fees, those fees are your responsibility and are charged by your financial institution, not by Reel Adventure Booking.

11.7 Pricing Errors and Corrections

Although we strive to maintain accurate pricing information, errors may occur. If we identify a material pricing error or discrepancy, we may take reasonable steps to correct the error, which may include:

  • Updating the listing or checkout totals.
  • Notifying you before confirming a Booking.
  • Canceling a Booking and issuing a refund of amounts collected through the Platform if a Booking was confirmed based on a material error.

If a Booking is canceled due to a pricing error, your sole remedy is a refund of the amounts actually paid through the Platform for that Booking, unless applicable law provides additional rights.

12. Payments and Payment Processing

The Platform supports online payments through Stripe. Depending on the Trip and the timing of the Booking, you may be required to pay a Deposit, Full Payment, and/or a Remaining Balance. Payment options and timing are disclosed during checkout and may vary by Trip, Captain, location, and other operational factors.

You authorize Reel Adventure Booking and Stripe to process your payments in accordance with these Terms and the checkout disclosures applicable to your Booking.

12.1 Payment Processor and Payment Method Handling

All online payments made through the Platform are processed by Stripe. The Platform uses Stripe's secure payment components to collect payment details. Reel Adventure Booking does not store full card numbers, card verification codes, or bank account numbers. Payment information you provide is transmitted directly to Stripe and handled in accordance with Stripe's processes and security standards.

You acknowledge and agree that your use of Stripe in connection with the Platform may be subject to Stripe's terms, policies, and requirements. Reel Adventure Booking is not responsible for Stripe's services, including service interruptions, processing delays, security features, charge outcomes, or card issuer decisions.

12.2 Authorization to Charge and Payment Acceptance

By submitting payment information through the Platform, you represent that you are authorized to use the payment method and you authorize the Platform and Stripe to charge the payment method for amounts disclosed during checkout, including any applicable platform fees and taxes.

A transaction is not complete until it is accepted and successfully processed by Stripe and the applicable payment method issuer. Stripe and the issuer may decline or reverse a charge for reasons outside the Platform's control, including suspected fraud, insufficient funds, expired credentials, or issuer restrictions.

12.3 Deposit Payments

For certain Trips, you may be permitted or required to pay a Deposit to hold or confirm a reservation. Unless disclosed otherwise during checkout:

  • A Deposit is commonly twenty percent (20%) of the Trip price.
  • The Deposit is charged at checkout to confirm the Booking.
  • The Deposit may be non-refundable or partially refundable depending on the cancellation and refund terms disclosed during checkout.
  • Payment of a Deposit does not eliminate your responsibility to pay any Remaining Balance when due.

If a Trip requires a Deposit, the amount and the timing of any Remaining Balance will be disclosed before you complete checkout.

12.4 Full Payments

For certain Trips, the Platform may require or allow Full Payment at checkout. When Full Payment applies, you authorize Stripe to charge the full Trip price and any applicable fees and taxes at checkout. A Booking may not be confirmed unless Full Payment is successfully processed.

12.5 Remaining Balance Payments and Timing

If you pay a Deposit rather than Full Payment, you may owe a Remaining Balance. The due date and payment method for the Remaining Balance depend on the specific Trip and may include one or more of the following:

  • Payment of the Remaining Balance online through the Platform on a future date.
  • Payment of the Remaining Balance online through the Platform when prompted, such as when the cancellation window closes or when the Trip date approaches.
  • Payment of the Remaining Balance in person directly to the Captain or Operator if the Trip is not eligible for online Remaining Balance payments.

The applicable Remaining Balance terms will be disclosed during checkout and may also be reflected in your booking confirmation materials. You are responsible for understanding and complying with the Remaining Balance requirements for your Booking.

12.6 In-Person Payments to Captains and Operators

For some Trips, the Platform may not support online payment of the Remaining Balance. In those cases, you may be required to pay the Remaining Balance in person to the Captain or Operator. When in-person payment applies:

  • Reel Adventure Booking is not the merchant of record for the in-person payment.
  • The in-person payment is made directly to the Captain or Operator and is outside the Platform's payment processing.
  • The Captain or Operator is solely responsible for providing receipts, handling disputes, processing refunds for in-person amounts, and complying with applicable payment laws for the in-person transaction.

If you fail to pay any required in-person Remaining Balance, the Captain or Operator may treat the Booking as a no-show or customer cancellation, and you may forfeit amounts previously paid through the Platform subject to the cancellation and refund terms disclosed at checkout.

12.7 Stripe Connect Payout Structure and Platform Fees

Certain online payments may be processed through Stripe Connect in a manner that routes funds to the Captain's or Operator's connected account, subject to Stripe's payout schedules, verification requirements, and compliance controls. The Platform may retain a platform fee, where applicable, which may be configured as a Stripe application fee.

You acknowledge that payout timing to Captains and Operators may vary and that Stripe may impose reserves, delays, or holds based on risk assessments, verification status, disputes, chargebacks, or other factors. Such delays do not create liability for Reel Adventure Booking to you.

12.8 Payment Authorizations, Holds, and Capture

In some cases, including shared-seat Trips or capacity-limited Trips, the Platform may use payment authorization and capture mechanics to confirm availability and reduce the risk of overbooking. This may include:

  • Authorizing your payment method for an amount disclosed at checkout.
  • Capturing the authorized amount after a final availability check.
  • Voiding an authorization if the Trip becomes unavailable before capture.

If a payment is authorized but not captured, your payment method issuer may temporarily hold the authorized amount. The timing of release of an authorization hold is determined by your payment method issuer and is outside the Platform's control.

12.9 Failed Payments and Responsibility to Cure

If any payment attempt fails, including a Deposit charge, Full Payment charge, or Remaining Balance charge, your Booking may be canceled, suspended, or marked as unpaid. Reel Adventure Booking may provide notice through the Platform or by email or text message where available.

You are responsible for promptly updating your payment method and completing payment when due. Failure to cure a failed payment may result in:

  • Cancellation of the Booking.
  • Loss of the reserved Trip date or seat.
  • Forfeiture of a Deposit where the cancellation terms allow.
  • Suspension or restriction of your account.

12.10 Chargebacks and Payment Disputes

If you initiate a chargeback, payment dispute, or reversal with your card issuer or financial institution, Reel Adventure Booking may suspend your account and may cancel pending or future Bookings. You agree to cooperate with reasonable requests for information related to chargebacks, fraud investigations, and payment disputes.

Chargebacks and disputes may affect the availability of refunds and may result in additional limitations on your ability to use the Platform. The Platform may seek reimbursement for chargeback fees, administrative costs, and losses caused by unauthorized or improper disputes to the extent permitted by law.

12.11 Refund Method and Timing

If a refund is owed for an amount paid through the Platform, refunds are generally issued to the original payment method through Stripe. Refund timing depends on Stripe processing times and your payment method issuer. Reel Adventure Booking does not control the time it takes your bank or card issuer to post the refund after it has been initiated.

Refunds for amounts paid in person to Captains or Operators are handled solely by the Captain or Operator unless the Platform expressly states otherwise in writing for a specific Trip.

13. Scheduled Auto-Pay for Remaining Balances

For certain Trips, the Platform may offer an optional Scheduled Auto-Pay feature that allows the Remaining Balance to be charged automatically on a scheduled date. Scheduled Auto-Pay is not available for all Trips. Availability, timing, and applicable conditions are disclosed during the booking flow.

If Scheduled Auto-Pay is offered for your Trip and you choose to enable it, you authorize the Platform and Stripe to store a Stripe reference to your selected payment method and to attempt to charge the Remaining Balance automatically on the scheduled date disclosed to you.

13.1 Opt-In Authorization and Consent

Scheduled Auto-Pay is optional. You must affirmatively choose it where the option is offered. By opting in, you authorize:

  • Stripe to store a tokenized reference to your selected payment method, not raw card data.
  • The Platform and Stripe to attempt to charge the Remaining Balance in accordance with the schedule disclosed at checkout or in your booking confirmation.
  • The Platform to provide you with notices related to Scheduled Auto-Pay attempts, outcomes, and required actions.

Your authorization remains in effect for the specific Booking for which you selected Scheduled Auto-Pay unless you cancel the Booking in accordance with the applicable cancellation terms or Scheduled Auto-Pay is disabled as described below.

13.2 Scheduled Charge Timing and Amount

The scheduled charge date is generally set to align with Trip operations and the applicable cancellation window. The scheduled date and the amount to be charged will be disclosed during checkout or in the booking confirmation for that Trip.

The Platform will attempt to charge the Remaining Balance on or near the scheduled date. Actual processing timing may vary due to Stripe processing, card issuer rules, weekends, holidays, or system delays.

If the Remaining Balance changes due to an approved modification to the Booking, the Scheduled Auto-Pay amount may also change. Where required by applicable law, you will receive updated disclosures.

13.3 Customer Responsibilities for Auto-Pay

If you opt in to Scheduled Auto-Pay, you agree that:

  • You will maintain a valid payment method on file for the scheduled charge.
  • You are responsible for ensuring sufficient available funds or credit limit to cover the Remaining Balance.
  • You will promptly update your payment method if it expires, is replaced, or becomes invalid.
  • You will monitor your email and Platform notifications for payment-related notices.

You remain responsible for timely payment of the Remaining Balance even if Scheduled Auto-Pay is enabled.

13.4 Failed Auto-Pay Charges

If Stripe is unable to successfully charge your payment method on the scheduled date for any reason, including insufficient funds, issuer declines, or suspected fraud, the Scheduled Auto-Pay attempt may fail.

If an auto-pay charge fails:

  • The Platform may disable Scheduled Auto-Pay for that Booking.
  • You may be required to provide a new payment method or complete payment through another available method.
  • The Booking may be treated as unpaid until the Remaining Balance is satisfied.
  • If payment is not cured within the time period disclosed in your booking flow or notifications, the Booking may be canceled and the applicable cancellation terms may apply, including forfeiture of a Deposit to the extent permitted by law and disclosed at checkout.

The Platform may, but is not obligated to, attempt additional re-tries after a failed charge. Any retry schedule, if used, may depend on Stripe settings and issuer rules and may not be communicated in advance.

13.5 Disabling Auto-Pay

Scheduled Auto-Pay may be disabled under any of the following circumstances:

  • You cancel the Booking in accordance with the cancellation policy, resulting in no Remaining Balance being due.
  • The Captain or Operator cancels the Trip or the Booking is otherwise canceled.
  • Stripe or the Platform determines that a charge attempt is not permitted or should not be attempted due to risk controls, verification status, or compliance requirements.
  • Your payment method is invalid, removed, or cannot be charged.
  • A charge attempt fails, in which case the feature may be disabled and you will be required to pay by another method.

Disabling Scheduled Auto-Pay does not cancel your Booking and does not eliminate your obligation to pay the Remaining Balance when due.

13.6 Customer Requests to Stop Auto-Pay

If you opt in to Scheduled Auto-Pay and later wish to stop the scheduled charge, you must follow the options provided in your account settings or contact Platform support if the Platform provides that method. Stopping Scheduled Auto-Pay does not change the Booking terms and does not eliminate your obligation to pay the Remaining Balance by the due date.

If you stop Scheduled Auto-Pay after the cancellation window has closed or after payment is due, you may still be obligated to pay the Remaining Balance and you may be subject to the cancellation and no-show terms applicable to the Booking.

13.7 Disputes and Chargebacks Related to Auto-Pay

If you dispute a Scheduled Auto-Pay charge through your card issuer rather than using the Platform's support and refund processes, the dispute may be treated as a payment dispute under these Terms. Reel Adventure Booking may suspend or restrict your account, and the Booking may be canceled or marked unpaid while the dispute is pending.

14. Cancellations and Refunds

Cancellation and refund outcomes depend on the specific Trip you book, the timing of cancellation, and the cancellation terms disclosed in the Trip listing and during checkout. Because Captains and Operators are independent businesses with varying policies and operating constraints, cancellation rules may differ by Trip.

You are responsible for reviewing and understanding the cancellation and refund terms that apply to your Booking before completing checkout.

14.1 Trip-Specific Cancellation Terms Control

Each Trip listing and checkout flow may include cancellation and refund terms that apply to that Booking, including cancellation deadlines, refund percentages, rescheduling options, no-show rules, and weather-related outcomes. Those Trip-specific terms are part of your Booking and may control over general statements in these Terms to the extent of any conflict.

If you book a Trip that requires a Deposit, you acknowledge that Deposits are commonly non-refundable or partially refundable after certain deadlines, as disclosed during checkout.

14.2 How to Cancel a Booking

To cancel a Booking, you must use the cancellation tools provided in the Platform or follow the cancellation instructions included in your booking confirmation. Cancellation requests made outside the Platform, including by messaging a Captain directly, may not be recognized as a valid cancellation for refund purposes.

A cancellation is effective only when the Platform confirms the cancellation or otherwise records the cancellation within your account or booking confirmation history.

14.3 Customer Cancellations

If you cancel a Booking, refunds, credits, or forfeitures will be determined by the cancellation policy disclosed at checkout for that Trip. Cancellation outcomes may include:

  • A full refund if canceled within a specified window.
  • A partial refund based on how close the cancellation is to the Trip date.
  • Forfeiture of the Deposit while refunding some or all remaining amounts paid through the Platform.
  • No refund for cancellations within a late window or for no-shows, subject to applicable law.

Where permitted by law and disclosed at checkout, cancellation fees may apply. If a Platform fee is disclosed as non-refundable, it may be retained even if some portion of the Trip price is refunded.

14.4 Rescheduling Requests

Rescheduling is not guaranteed and depends on the Captain's availability and the Trip's rescheduling rules. If rescheduling is offered, the applicable terms may include:

  • A deadline for requesting a reschedule.
  • Limits on the number of reschedules.
  • A rescheduling fee.
  • Conversion of amounts paid into a credit rather than a refund.

If a reschedule request is denied or cannot be accommodated, your Booking will remain subject to the original cancellation policy.

14.5 Captain or Operator Cancellations

Captains and Operators may cancel Trips due to weather, safety concerns, mechanical issues, crew availability, licensing constraints, or other operational reasons. If a Captain or Operator cancels:

  • The Platform will provide notice where reasonably practicable.
  • Amounts paid through the Platform for the canceled Booking will generally be refunded or credited in accordance with the Trip-specific cancellation terms and applicable law.
  • If the Platform offers options such as rebooking with another Captain, rescheduling, or credits, those options will be presented when available.

Reel Adventure Booking does not guarantee the availability of replacement Trips or substitute Captains.

14.6 Weather, Safety, and Force Majeure Cancellations

Fishing charters are weather-dependent and safety-sensitive. Trips may be delayed, shortened, rescheduled, or canceled based on conditions that make the Trip unsafe or impractical, including severe weather, marine advisories, unsafe sea state, lightning, flooding, fire conditions, or other hazards.

Weather and safety decisions are primarily made by the Captain or Operator as the person responsible for vessel operation. If a Trip is canceled or materially modified due to weather or safety:

  • Refund or rescheduling outcomes will be governed by the Trip-specific policy disclosed at checkout.
  • A Captain may offer rescheduling rather than a refund, or may provide partial refunds in some circumstances, depending on the Trip's rules.
  • If a Trip is started but ended early due to safety conditions, refunds are not guaranteed and will depend on Trip-specific terms and the circumstances.

You acknowledge that weather conditions can change quickly and that Trip modifications due to safety concerns do not entitle you to a refund unless expressly stated in the applicable cancellation policy.

14.7 No-Shows and Late Arrivals

You are responsible for arriving at the departure location on time and complying with the Captain's check-in instructions. A "no-show" may occur if you or your party fail to appear, arrive too late to reasonably conduct the Trip, fail to provide required documentation, or are refused service due to intoxication, unsafe conduct, or violation of Trip rules.

No-shows and late arrivals are generally treated as customer cancellations and may result in forfeiture of amounts paid, including Deposits, to the maximum extent permitted by law and disclosed at checkout.

14.8 Refund Method and Processing Time

Refunds for amounts paid through the Platform are generally issued back to the original payment method through Stripe. Processing time depends on Stripe and your financial institution. Reel Adventure Booking does not control when your bank or card issuer posts a refund after it has been initiated.

If a refund is issued as a credit, the terms of credit use, expiration, and limitations will be disclosed at the time the credit is offered.

Refunds for amounts paid in person directly to a Captain or Operator are handled solely by the Captain or Operator unless the Platform expressly states otherwise in writing for the specific Trip.

14.9 Chargebacks Do Not Replace the Refund Process

If you initiate a chargeback or payment dispute instead of using the Platform's cancellation and refund process, Reel Adventure Booking may suspend your account and may treat the dispute as a violation of these Terms where the dispute is improper. Chargebacks may delay or prevent refunds and may result in additional restrictions on your ability to book Trips.

14.10 Platform Assistance and Limits

Reel Adventure Booking may provide support to facilitate communication and help resolve cancellation-related issues, but we do not control Captain decisions and we do not guarantee a particular refund outcome beyond what is required by applicable law and the Trip-specific terms you accepted at checkout.

15. Trip Conduct and Participant Responsibilities

You are responsible for your conduct and the conduct of all passengers in your party during all interactions related to a Trip, including communications through the Platform, arrival and boarding procedures, and participation on the water. Captains and Operators may impose Trip-specific rules in addition to these Terms. You agree to comply with all Captain instructions, vessel rules, and safety requirements.

15.1 Compliance With Captain Instructions and Vessel Rules

The Captain or Operator is responsible for operating the vessel and conducting the Trip. You agree to follow all reasonable instructions from the Captain or crew, including instructions related to:

  • Boarding and disembarkation procedures.
  • Seating, movement, and conduct on the vessel.
  • Use of safety equipment and emergency procedures.
  • Fishing methods, gear handling, and hook safety.
  • Limits on passenger activity during navigation.
  • Any restrictions imposed by law, marina rules, or Coast Guard requirements.

Failure to follow Captain instructions may result in removal from the Trip, early termination of the Trip, or refusal of service, without refund, to the extent permitted by law and consistent with the cancellation terms disclosed at checkout.

15.2 Safety Requirements and Fitness to Participate

You are responsible for ensuring that you and your party are physically and medically able to participate in the Trip. You must disclose to the Captain, through the Platform or as otherwise instructed, any conditions that may affect safe participation, including mobility limitations, medical conditions, allergies relevant to onboard conditions, or special assistance needs.

You agree that the Captain may refuse participation to any individual who appears unfit for safe travel on the water, who cannot comply with safety instructions, or whose presence creates a safety risk to themselves or others.

15.3 Required Documentation and Legal Compliance

Certain Trips may require you or members of your party to possess valid identification, fishing licenses, permits, or other documentation. You are responsible for ensuring that you comply with applicable laws and regulations, including licensing requirements for the Trip location and species targeted.

If you or your party fail to provide required documentation, fail to meet age requirements, or otherwise cannot lawfully participate, the Captain may treat the issue as a customer cancellation or no-show, and refunds are not guaranteed.

15.4 Prohibited Conduct

You agree not to engage in conduct that is unsafe, unlawful, abusive, or disruptive. Prohibited conduct includes:

  • Intoxication or impairment that creates safety risk.
  • Possession of illegal drugs or unlawful weapons.
  • Harassment, discrimination, threats, or abusive behavior toward the Captain, crew, or other passengers.
  • Damage to the vessel, equipment, docks, or marina property.
  • Interference with vessel operation or safety equipment.
  • Any conduct that violates applicable law or marina rules.

Captains and Operators may refuse service or end a Trip early if prohibited conduct occurs. Such actions may result in forfeiture of amounts paid, including Deposits, to the extent permitted by law and consistent with the cancellation terms disclosed at checkout.

15.5 Alcohol, Smoking, and Controlled Substances

Rules regarding alcohol, smoking, vaping, and controlled substances vary by Trip and Captain. You are responsible for reviewing the Trip listing and following Captain rules. If a Captain permits alcohol, you agree to consume responsibly and in a manner that does not create safety risks or disrupt the Trip.

The Captain may refuse service or terminate a Trip if alcohol or substance use creates safety risks. No refund is required in such cases unless mandated by applicable law or expressly stated in the Trip-specific terms.

15.6 Assumption of Risk

You acknowledge that fishing, boating, and on-water activities involve inherent risks, including risks that cannot be eliminated even with reasonable safety measures. These risks include, without limitation:

  • Slips, falls, and trip hazards on wet or moving surfaces.
  • Sea conditions, waves, wakes, and sudden vessel movement.
  • Weather changes, lightning, and temperature exposure.
  • Motion sickness and related medical events.
  • Injuries from fishing hooks, lines, knives, gaffs, and equipment.
  • Contact with marine life, including bites, stings, and allergic reactions.
  • Travel-related risks, including collisions, grounding, or mechanical failure.

By booking and participating in a Trip, you voluntarily assume all inherent risks associated with fishing charters and boating activities, whether occurring on the vessel, on docks, during boarding, or during related activities.

15.7 Customer Responsibility for Personal Property

You are responsible for safeguarding personal property brought on the Trip, including phones, cameras, wallets, jewelry, and gear. Conditions on the water may involve spray, moisture, and movement. Reel Adventure Booking is not responsible for loss, theft, or damage to personal property during a Trip. Captains and Operators may have additional limitations or recommendations regarding what to bring onboard.

15.8 Removal, Trip Termination, and Related Consequences

The Captain or Operator may deny boarding, remove passengers, or terminate a Trip if necessary for safety, compliance, or operational reasons, including where:

  • A passenger is intoxicated, aggressive, or non-compliant.
  • A passenger creates a safety hazard.
  • Required documentation is missing.
  • Conditions arise that make continuation unsafe.

If a Trip is terminated or service is refused under this section due to conduct or non-compliance, refunds are not guaranteed and will be determined in accordance with the Trip-specific cancellation policy and applicable law. You may also be responsible for damages caused by you or your party, including cleaning costs, equipment damage, or other losses to the Captain or Operator.

16. Insurance and Risk Allocation

Captains and Operators are solely responsible for maintaining vessel insurance and any other insurance required for their operations. Reel Adventure Booking does not provide insurance coverage for Customers, passengers, or Trips, and does not guarantee that any Captain or Operator maintains any particular type or level of insurance.

16.1 Captain and Operator Insurance Responsibilities

Captains and Operators are expected to maintain valid and appropriate insurance for their business and vessel operations, which may include, depending on the Trip and jurisdiction:

  • Vessel and hull coverage.
  • Protection and indemnity or other marine liability coverage.
  • Commercial general liability coverage.
  • Business insurance appropriate to the nature of the charter services.

Reel Adventure Booking may require Captains and Operators to submit proof of insurance for administrative review as a condition of listing on the Platform. Any such review is for Platform integrity and screening purposes only and does not constitute verification of coverage, adequacy, scope, enforceability, or claims handling.

You acknowledge that insurance is a complex product and that coverage availability and claims outcomes depend on policy terms, exclusions, and carrier determinations. Reel Adventure Booking is not an insurance broker, agent, or advisor and does not provide insurance advice.

16.2 No Guarantee of Coverage or Recovery

Even if a Captain or Operator maintains insurance, coverage may not apply to all incidents, injuries, property damage, cancellations, weather-related losses, or other events. Coverage may be limited by policy exclusions, failure to satisfy policy conditions, misrepresentations, or carrier decisions.

Reel Adventure Booking does not guarantee that any loss you suffer will be covered by a Captain's or Operator's insurance, and Reel Adventure Booking does not guarantee recovery from any Captain, Operator, or insurer.

16.3 Customer Responsibility for Personal Insurance

You are responsible for obtaining and maintaining any insurance coverage you believe is appropriate for your circumstances, which may include:

  • Health insurance.
  • Travel insurance.
  • Accident insurance.
  • Personal property insurance for items you bring on a Trip.
  • Coverage for trip interruption, cancellation, or related expenses.

If you travel to the Trip location from outside the area or from outside the United States, you are responsible for evaluating whether your insurance coverage applies in the Trip location and for your planned activities.

16.4 Allocation of Risk Between Platform and Trip Providers

You acknowledge and agree that:

  • The Captain or Operator is responsible for the Trip, including vessel operation, safety, crew conduct, equipment, route decisions, and compliance with applicable laws.
  • Reel Adventure Booking is not responsible for Trip operations and does not assume liability for the acts or omissions of any Captain, Operator, passenger, or third party, except as expressly stated in these Terms.
  • Any claims, disputes, injuries, losses, or damages arising from a Trip are primarily matters between you and the Captain or Operator, subject to the limitations and dispute resolution provisions in these Terms.

16.5 No Medical Services

Reel Adventure Booking does not provide medical services and does not guarantee that Captains or Operators are trained medical providers. Captains may have basic safety equipment, but medical response capability can be limited on the water.

You are responsible for bringing any necessary medications, informing your party of any medical needs, and seeking medical care as appropriate. If an emergency occurs, you authorize the Captain to take reasonable actions to seek emergency assistance, and you agree to bear the costs of emergency services to the extent not covered by insurance.

17. Communications Between Customers and Captains

The Platform may provide messaging, chat, email relay, or other communication tools that allow Customers and Captains or Operators to exchange information regarding Trips, Bookings, scheduling, pickup locations, and Trip requirements. These tools are provided to facilitate Trip coordination and improve user experience.

17.1 Use of Platform Communication Tools

You agree to use Platform communication tools only for legitimate purposes related to:

  • Inquiries about Trip listings.
  • Coordination of confirmed Bookings.
  • Clarification of Trip requirements.
  • Reasonable customer support needs.

You agree not to use Platform communication tools for spam, harassment, solicitation, advertising unrelated services, or any unlawful or abusive purpose.

17.2 No Guarantee or Monitoring of Communications

Reel Adventure Booking does not guarantee the accuracy, truthfulness, tone, or legality of communications sent by Captains, Operators, or other users. The Platform does not routinely monitor private communications and does not assume responsibility for the content of user messages.

However, the Platform may review, store, or access communications where reasonably necessary to:

  • Investigate suspected fraud or misuse.
  • Respond to safety complaints or legal requests.
  • Resolve Booking disputes.
  • Enforce these Terms.
  • Comply with applicable law.

17.3 Prohibition on Circumventing the Platform

You agree not to use Platform communications to:

  • Arrange or encourage bookings outside the Platform.
  • Avoid platform fees.
  • Exchange payment details for off-platform payment.
  • Solicit future trips that bypass the Platform.

Circumventing the Platform undermines marketplace integrity. If Reel Adventure Booking reasonably determines that you attempted to bypass the Platform, we may suspend or terminate your account, cancel related Bookings, and take other reasonable enforcement actions.

17.4 Recordkeeping and Retention

The Platform may retain communication records for a reasonable period for operational, fraud prevention, safety, dispute resolution, and legal compliance purposes. Communication retention practices are further described in the Privacy Policy.

17.5 Off-Platform Communications and Risk

If you choose to communicate with a Captain or Operator outside the Platform, including by phone, text message, or external email, such communications occur at your own risk. Reel Adventure Booking is not responsible for disputes, misrepresentations, payment issues, or harm arising from off-platform communications or arrangements.

18. Ratings and Reviews

The Platform may allow Customers to submit ratings, reviews, feedback, comments, or other content regarding Trips, Captains, or Operators. Ratings and reviews help improve marketplace transparency and assist other Customers in making informed booking decisions.

18.1 Eligibility to Submit Reviews

Only Customers who have completed a confirmed Booking through the Platform may be eligible to submit a review for that specific Trip. Reel Adventure Booking may limit review submission to verified Bookings and may restrict review submission to a defined time period following Trip completion.

You agree that any review you submit will be based on your genuine experience and will reflect honest opinions.

18.2 Content Standards for Reviews

You agree that reviews and ratings you submit will:

  • Be truthful and based on your actual experience.
  • Not contain false, misleading, or defamatory statements.
  • Not include hate speech, threats, or discriminatory content.
  • Not disclose personal contact information or private information of another person.
  • Not contain obscene, unlawful, or abusive language.
  • Not promote other businesses or services.
  • Not be submitted in exchange for compensation unless disclosed as required by law.

18.3 Moderation and Removal Rights

Reel Adventure Booking reserves the right, but does not have an obligation, to review, screen, edit, or remove ratings and reviews that violate these Terms, violate applicable law, or undermine marketplace integrity.

Examples of content that may be removed include:

  • Reviews containing false or misleading claims.
  • Retaliatory or extortionate reviews.
  • Reviews submitted to manipulate ratings.
  • Content that violates safety, privacy, or harassment policies.

Removal of a review does not entitle you to resubmit the same content or to any compensation.

18.4 No Guarantee of Publication or Response

The Platform does not guarantee that any review will be published or remain posted indefinitely. Captains and Operators may respond to reviews, but Reel Adventure Booking does not require them to do so and does not mediate factual disputes in reviews.

18.5 License to Use Review Content

By submitting a review, you grant Reel Adventure Booking a non-exclusive, royalty-free, perpetual, irrevocable license to use, display, reproduce, distribute, and publish your review in connection with the Platform, marketing, and promotional activities, subject to applicable law and the Privacy Policy.

19. Liability Allocation

19.1 Responsibility for Trip Operations

Captains and Operators are solely responsible for:

  • Operating vessels and conducting Trips.
  • Providing equipment, gear, and safety devices.
  • Determining routes, timing, and weather-related decisions.
  • Ensuring compliance with maritime laws, licensing requirements, and safety regulations.
  • The actions and omissions of their crew and agents.

Reel Adventure Booking does not control or direct Trip operations and does not assume responsibility for the conduct, negligence, or wrongdoing of any Captain, Operator, crew member, passenger, or third party involved in a Trip.

19.2 Platform Provided "As Is"

The Platform and all related services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Reel Adventure Booking disclaims all warranties, whether express or implied, including:

  • Warranties of merchantability.
  • Fitness for a particular purpose.
  • Non-infringement.
  • Accuracy, reliability, or availability of the Platform.
  • Quality, safety, or suitability of any Trip or Captain.

We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components.

19.3 Limitation of Platform Liability

To the maximum extent permitted by law, Reel Adventure Booking will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to:

  • Your use of or inability to use the Platform.
  • Any Booking or Trip.
  • Actions or omissions of any Captain, Operator, crew member, or other passenger.
  • Personal injury, property damage, or loss occurring during a Trip.
  • Payment disputes, failed charges, or refund delays.
  • Communications or interactions between you and any Captain or Operator.

19.4 Liability Cap

To the extent permitted by law, in no event will Reel Adventure Booking's total liability to you for any claims arising out of or related to these Terms, the Platform, or any Booking exceed the total amount of platform fees actually paid by you to Reel Adventure Booking for the specific Booking giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. In such cases, Reel Adventure Booking's liability will be limited to the fullest extent permitted by applicable law.

19.5 No Liability for Third-Party Services

The Platform integrates third-party services, including Stripe payment processing and mapping, hosting, and communication services. Reel Adventure Booking is not responsible for the acts or omissions of third-party service providers or for interruptions, errors, or failures in third-party services.

Your use of third-party services may be subject to separate terms and privacy policies of those providers.

19.6 Acknowledgment of Inherent Risk

You acknowledge that fishing and boating involve inherent risks and that participation in a Trip is voluntary. To the maximum extent permitted by law, Reel Adventure Booking is not liable for injuries, deaths, losses, or damages resulting from inherent risks of fishing and boating activities.

19.7 Exceptions Where Liability Cannot Be Excluded

Nothing in these Terms excludes or limits liability for:

  • Gross negligence or willful misconduct where exclusion is not permitted by law.
  • Fraud or intentional misrepresentation.
  • Liability that cannot be limited or excluded under applicable law.

20. Indemnification

You agree to indemnify, defend, and hold harmless Reel Adventure Booking, its owners, officers, directors, employees, agents, affiliates, and representatives from and against any claims, demands, losses, liabilities, damages, judgments, awards, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • Your use of the Platform.
  • Any Booking or Trip you book or participate in.
  • Your conduct or the conduct of any member of your party.
  • Your violation of these Terms.
  • Your violation of any law, regulation, or third-party right.
  • Any content or communications you submit through the Platform, including reviews and messages.
  • Any payment dispute, chargeback, or reversal initiated by you in violation of these Terms.

This indemnification obligation includes claims brought by:

  • Captains or Operators.
  • Other passengers or third parties.
  • Government authorities.
  • Any person alleging injury, loss, or damage caused by you or your party.

Reel Adventure Booking reserves the right to assume control of the defense of any matter subject to indemnification at your expense. If we do so, you agree to cooperate fully in the defense and settlement of the matter. You may not settle any claim that imposes liability or obligations on Reel Adventure Booking without our prior written consent, which will not be unreasonably withheld.

Your indemnification obligations survive termination of your account, completion of your Trip, and termination of these Terms.

21. Force Majeure

Reel Adventure Booking, Captains, and Operators will not be liable for any delay, interruption, modification, or failure to perform any obligation related to a Booking or Trip where such delay or failure results from events or circumstances beyond reasonable control.

21.1 Force Majeure Events

Force majeure events include, without limitation:

  • Severe weather, storms, hurricanes, lightning, or dangerous sea conditions.
  • Natural disasters, including floods, fires, earthquakes, or tidal events.
  • Acts of government, regulatory actions, port or marina closures, or changes in law.
  • Labor disputes, strikes, or crew unavailability.
  • Mechanical failures, breakdowns, or unexpected vessel maintenance needs.
  • Fuel shortages or supply disruptions.
  • War, terrorism, civil unrest, or public safety emergencies.
  • Power outages, internet service interruptions, or hosting service failures.
  • Epidemics, pandemics, or public health emergencies.

21.2 Effect on Bookings and Trips

If a force majeure event affects a Trip:

  • The Captain or Operator may cancel, delay, shorten, or reschedule the Trip.
  • Reel Adventure Booking may assist with communication and facilitate available options.
  • Refunds, credits, or rescheduling outcomes will be determined by the Trip-specific cancellation policy disclosed at checkout, unless applicable law requires otherwise.

If a force majeure event affects the Platform:

  • Certain Platform features may be temporarily unavailable.
  • Booking processing, messaging, or payment features may be delayed or interrupted.
  • Reel Adventure Booking will not be liable for losses arising from Platform unavailability beyond its reasonable control.

21.3 No Additional Liability

A force majeure event does not entitle you to compensation, damages, or reimbursement beyond the refund or rescheduling rights expressly provided in the Trip-specific cancellation policy or required by applicable law.

22. Dispute Resolution and Governing Law

22.1 Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact Reel Adventure Booking through the Platform support channels to attempt to resolve the issue informally. Many concerns can be resolved quickly through customer support and communication with the Captain or Operator.

You agree to provide a brief written description of the dispute and allow a reasonable period for review and response before pursuing formal legal action.

22.2 Governing Law

These Terms, your use of the Platform, and any dispute arising out of or relating to these Terms, the Platform, or any Booking will be governed by and construed in accordance with the laws of the State where Reel Adventure Booking is organized, without regard to conflict of law principles.

If the governing law must be tied to a specific jurisdiction for regulatory or business reasons, the governing state may be updated in the final version of these Terms.

22.3 Jurisdiction and Venue

Except where arbitration is required by law or elected by the Company, any legal action or proceeding arising out of or relating to these Terms, the Platform, or a Booking must be brought in the state or federal courts located in the governing state described above. You consent to the personal jurisdiction of such courts and waive any objection to inconvenient forum.

22.4 Arbitration Option

Where permitted by applicable law, Reel Adventure Booking may require certain disputes to be resolved through binding arbitration rather than court litigation. If arbitration applies, the arbitration process, location, and applicable arbitration rules will be disclosed in the final version of these Terms or in a separate arbitration agreement.

22.5 No Class Actions

To the extent permitted by applicable law, disputes must be brought on an individual basis only. You agree not to bring or participate in class actions, collective actions, or representative proceedings against Reel Adventure Booking relating to the Platform, these Terms, or any Booking.

22.6 Injunctive Relief

Nothing in this section prevents Reel Adventure Booking from seeking injunctive or equitable relief in court to prevent unauthorized use of the Platform, intellectual property infringement, fraud, or misuse of the Platform.

23. Privacy and Data Use

Reel Adventure Booking respects your privacy and is committed to handling personal information in a responsible and transparent manner. Your use of the Platform and participation in Bookings involve the collection, use, and processing of personal data as described in this section and in the Privacy Policy.

23.1 Privacy Policy Controls

Our Privacy Policy explains how Reel Adventure Booking collects, uses, stores, shares, and protects personal information. By using the Platform or making a Booking, you acknowledge that you have reviewed the Privacy Policy and consent to the data practices described in it.

If there is any conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy controls.

23.2 Information Collected for Bookings

To facilitate Bookings and Trip operations, the Platform may collect personal information including:

  • Name, contact details, and account credentials.
  • Booking details and Trip preferences.
  • Payment-related information processed through Stripe.
  • Communications with Captains or Operators.
  • Emergency contact details where provided.

This information is used to confirm Bookings, coordinate Trips, provide support, prevent fraud, and comply with legal obligations.

23.3 Sharing of Information With Captains and Operators

When you submit a Booking, relevant information is shared with the Captain or Operator to allow them to deliver the Trip. Shared information may include your name, contact details, passenger count, Trip details, and any information you provide regarding special needs or requirements.

Captains and Operators are independent businesses and are responsible for their own handling of personal information. Reel Adventure Booking does not control or supervise how Captains and Operators store or use information once shared, although Captains are required to comply with Platform policies regarding proper use of customer information.

23.4 Payment Data and Stripe

Payment transactions are processed through Stripe. Reel Adventure Booking does not store full card numbers or bank account details. Stripe processes and stores payment information in accordance with its security standards and privacy practices.

Your use of Stripe services through the Platform may be subject to Stripe's terms and privacy policies. Reel Adventure Booking is not responsible for Stripe's independent data practices.

23.5 Communications and Support Records

The Platform may store communications between you and Captains or Operators through Platform messaging tools. These records may be used for customer support, dispute resolution, safety monitoring, fraud prevention, and legal compliance.

23.6 Marketing Communications

If you provide your email address or other contact information, you may receive transactional communications related to your account and Bookings. You may also receive marketing communications if you opt in or where permitted by law. You may opt out of marketing messages at any time using the unsubscribe features provided in such communications.

23.7 Data Retention

Reel Adventure Booking retains personal information for as long as reasonably necessary to provide the Platform services, comply with legal obligations, resolve disputes, enforce agreements, and maintain business records. Retention periods may vary based on the type of information and legal requirements.

23.8 International Users

The Platform may be accessed by users located outside the United States. If you access the Platform from outside the United States, you acknowledge that your information may be processed and stored in the United States or other jurisdictions where Reel Adventure Booking or its service providers operate. Data protection laws in such jurisdictions may differ from those in your home country.

24. Marketing Communications

Reel Adventure Booking may use the contact information you provide to send communications related to the Platform, your account, and your Bookings. This section explains how marketing and promotional communications are handled.

24.1 Transactional Communications

By creating an account or making a Booking, you consent to receive transactional communications that are necessary to provide the Platform services. Transactional communications may include:

  • Booking confirmations and receipts.
  • Trip reminders and departure instructions.
  • Payment confirmations and failed payment notices.
  • Cancellation and rescheduling notices.
  • Account security or policy updates.

Transactional communications are essential to the operation of the Platform and cannot be opted out of while maintaining an active account or Booking.

24.2 Marketing and Promotional Communications

Where permitted by applicable law, Reel Adventure Booking may send marketing or promotional communications, including newsletters, special offers, referral programs, and product updates.

You will receive marketing communications only if:

  • You have opted in through the Platform or blog subscription features, or
  • Applicable law permits marketing communications based on your relationship with the Platform.

24.3 Opt-Out Rights

You may opt out of marketing communications at any time by:

  • Clicking the unsubscribe link in a marketing email.
  • Adjusting your communication preferences in your account settings, where available.
  • Contacting Platform support to request removal from marketing lists.

Opting out of marketing communications does not affect your receipt of transactional communications related to your account or Bookings.

24.4 Third-Party Marketing

Reel Adventure Booking does not sell your personal contact information to unaffiliated third parties for their independent marketing purposes without your consent. However, the Platform may engage third-party service providers to assist with email delivery and marketing automation, subject to contractual confidentiality and data protection obligations.

25. Intellectual Property

All content, features, and functionality of the Platform are owned by Reel Adventure Booking or its licensors and are protected by intellectual property laws. This section explains your rights to use the Platform and the restrictions that apply.

25.1 Platform Ownership

The Platform, including but not limited to:

  • Website and mobile interfaces.
  • Software, code, and system architecture.
  • Logos, trademarks, service marks, and branding.
  • Text, graphics, images, videos, and design elements.
  • Databases, compilations, and data structures.

are the exclusive property of Reel Adventure Booking or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.

Nothing in these Terms transfers any ownership interest in the Platform or its content to you.

25.2 Limited License to Use the Platform

Subject to your compliance with these Terms, Reel Adventure Booking grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for:

  • Browsing Trip listings.
  • Communicating with Captains and Operators through Platform tools.
  • Making legitimate Bookings for personal, non-commercial use.

You may not use the Platform for commercial resale of Trips, data extraction, scraping, competitive analysis, or any other commercial purpose without Reel Adventure Booking's prior written consent.

25.3 Restrictions on Use

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the Platform.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use automated tools to access or scrape Platform content without permission.
  • Remove, alter, or obscure proprietary notices or branding.
  • Register or use trademarks, domain names, or social media accounts that imitate or infringe Reel Adventure Booking's branding.

25.4 User Content and License Grant

If the Platform allows you to submit content, including reviews, messages, or feedback, you retain ownership of your content. However, by submitting content through the Platform, you grant Reel Adventure Booking a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, and publish such content for Platform operations, marketing, and promotional purposes, subject to applicable law and the Privacy Policy.

25.5 Intellectual Property Complaints

If you believe that any content on the Platform infringes your intellectual property rights, you may submit a complaint to Reel Adventure Booking through the contact information provided in the Platform. We may remove or restrict access to content that we reasonably believe infringes intellectual property rights.

26. Termination of Use

26.1 Termination by You

You may stop using the Platform at any time. Where account deletion tools are available, you may request deletion of your account through your account settings or by contacting Platform support.

Account deletion or discontinuation of Platform use does not automatically cancel existing Bookings. Any confirmed Bookings remain subject to the cancellation and refund terms disclosed at checkout. You are responsible for canceling confirmed Bookings separately if you no longer intend to participate.

26.2 Suspension or Termination by Reel Adventure Booking

Reel Adventure Booking may suspend or terminate your account, restrict your access to the Platform, or cancel Bookings if we reasonably determine that:

  • You have violated these Terms or other Platform policies.
  • You have engaged in fraudulent activity or payment abuse.
  • You have initiated improper chargebacks or payment disputes.
  • You have harassed, threatened, or abused Captains, Operators, staff, or other users.
  • You have attempted to circumvent the Platform or arrange off-platform bookings.
  • Your actions create safety, security, or legal risk to the Platform or others.
  • Continued access is required to be restricted by law or regulatory request.

Where reasonably practicable, we will provide notice of suspension or termination. However, immediate action may be taken where necessary to prevent fraud, harm, or security threats.

26.3 Effect on Existing Bookings

If your account is suspended or terminated:

  • Confirmed Bookings may remain active unless canceled by you or the Captain, subject to safety and operational considerations.
  • Reel Adventure Booking may cancel existing Bookings if continued participation would create safety, fraud, or compliance risk.
  • Refunds, if any, will be handled in accordance with the Trip-specific cancellation terms and applicable law.

Termination of your account does not relieve you of payment obligations already incurred, including Remaining Balances due for confirmed Bookings.

26.4 Survival of Certain Provisions

The following sections survive termination of these Terms and your account:

  • Liability Allocation
  • Indemnification
  • Dispute Resolution
  • Intellectual Property
  • Privacy and Data Use
  • Any payment obligations owed
  • Any other provisions that by their nature are intended to survive termination

27. Modifications to These Terms

Reel Adventure Booking may revise these Terms from time to time to reflect changes in the Platform, legal requirements, or business practices. When revisions are made, the Effective Date at the top of this document will be updated.

If changes are material, Reel Adventure Booking may provide additional notice through the Platform or by email. Your continued access to or use of the Platform after updated Terms are posted constitutes your acceptance of the revised Terms.

If you do not agree to revised Terms, you must discontinue use of the Platform and cancel any pending Bookings in accordance with applicable cancellation policies.

28. Miscellaneous Provisions

28.1 Entire Agreement

These Terms, together with the Privacy Policy and any Trip-specific disclosures presented at checkout, constitute the entire agreement between you and Reel Adventure Booking regarding use of the Platform and supersede any prior agreements or understandings.

28.2 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

28.3 No Waiver

Failure by Reel Adventure Booking to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Reel Adventure Booking.

28.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without prior written consent from Reel Adventure Booking. Reel Adventure Booking may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.

28.5 Relationship of the Parties

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Reel Adventure Booking. You have no authority to bind Reel Adventure Booking in any manner.

28.6 Notices

Notices to you may be provided through the Platform, by email, or by other reasonable means using the contact information in your account. Notices to Reel Adventure Booking may be provided through the contact methods listed on the Platform website.

28.7 Headings

Section headings in these Terms are for convenience only and do not affect interpretation of the provisions.
